RE: Ladies Workout Express and National Fitness Financial

To whom it may concern:

I would like to file a complaint concerning Ladies Workout Express and National Fitness Financial for fraudulent business practices.

In June of this year my wife mailed a letter to National Fitness Financial giving 30 day notice that she would not be renewing my membership to Ladies Workout Express. This was per their contract requirements.in July via telephone they claimed to have never received her letter mailed in June.

On July 3rd she mailed a check in the amount of $41.63 cents to National Fitness Financial to cover my June obligation and the penalty for terminating her obligation early and again expressed her desire to terminate her membership.in August after several phone calls from them she mailed a copy of the original June 30 day notice letter. Later in August she received another phone call stating that the only thing they received was an empty envelope. On August 21st, per their instruction she faxed a copy of the June letter to the National Fitness Financial office from A UPS store so she would have a receipt. They stated later by phone that they never received the fax and proceeded to bill her for July and August membership.

On October 27th she mailed a certified letter to National Fitness Financial demanding that they cease and desist all fraudulent billing and harassment. She also included copies of all previous correspondence. She then copied the Bernalillo County District Attorney. On October 29th the letter was received by them and signed for by a Mr. D. Bidely. On November 8th I received a phone call from National Fitness Financial and they stated that the had not received the certified letter and that they had never heard of a D. Bidely

As a side note, all correspondence has been mailed to National Fitness Financial, Member Services Department, PO Box 497, Layton UT 84041.

I feel that she has been scammed by this outfit. Two letters, a FAX and a Certified letter which they claim were not received is no coincidence, its fraud, hence the complaint.
