Took money for something they didn't even have in stock to sell and now won't refund

In June I ordered some motorcycle riding boots; boots didn't arrive but backorder did... Patiently waited for six weeks before asking for cancellation and refund... It's now been over three months since the took my money and they refuse to refund it. That's THEFT!
