August 05 I came across a "redbull vending franchise" on franchisegator.com I signed a contract to purchase 4 machines for the sum of $13,100. This was to include the first inventory, a warranty to cover everything including theft and vandalism, a locating service that would place the machines in "qualified" locations, and most importantly "protected territory" under a franchise agreement.

I sent in a certified check along with the signed contract. A contract that stated I had the exclusive rights to a certian mapped out territory in No. Jersey. Everything discussed with Andrew Kennedy and his ghoul Don Goldfarb, along with the verbage in the contract, clearly depicted that I was purchasing a FRANCHISE for vending RedBull with exclusive territory and liscensing rights to the RedBull brand and trademarks. I still believe this to be true. Therefore, RedBull is in breach of contract for placing company machines in my "guarenteed protected territory" but i digress...

I paid for the machines in early october 05 and did not receive them until sometime in early 06. When they arrived, they were delivered by a shotty trucking co. One was actually laying on its side with a big dent on that side.

To make a long story short, the warranty never existed. The locating company was completely clueless. They couldn't place a tail on a donkey with no blindfold and 20/20 vision! My protected territory was encroached upon by RedBull itself and other private vendors. I was told by RedBull that I do not have rights to its trademark and licensing. (as per the language of the contract, I firmly believe I/we do in fact have rights to the trademark and licensing)

In a nutshell, CCA was 100% a scam. So much so that i believe RedBull itself was scammed by them. However, that does not or would not exempt RedBull from the liability CCA caused scamming people using their name. RedBull should step up and right a serious wrong they created... Having some prior experience in the vending business, i managed to place the machines myself. One was placed in a hotel and was vandalized. Would have been nice to tap into that warranty I paid for to have it fixed! The others are in gyms and one car wash. They do nowhere near the numbers I was led to believe. But for that there is obviously no recourse. However, for the breach of contract on many levels I firmly believe together we have plenty of recourse! Enough so that we can force RedBull to right the horrible injustice they've allowed to unfold with their name, trademark and product.
