We negotiated the following contract:
Scope of Work
Roofing
1) Remove all old roofing on home.
2) Replace any rotted decking.
3) Furnish and install G.A.F. 20yr fiber glass shingles with 15lb felt.
4) Replace metal edging.
Windows
1) Remove all windows on home.
2) Furnish and install Atrium mill finished Low-E glass replacement windows.
3) Haul and clean all trash and debris.
Total $4,720.00
Deposit $2,360.00
Final $2,360.00

I was approved for a small line of credit loan, and signed the above contract and mailed a check for the deposit of $2,360.00 on September 20. The check was cashed on October 3rd 2007 at Washington Mutual Bank Plano, Texas 75093-5156.
As of today April 21st, four windows have been delivered to the home and not installed. My last correspondence with Nick Fitzgerald as on or about early November of when he committed to commence work the first week of December. I have attempted to contact Nick Fitzgerald weekly since November of he has yet to return any of my telephone calls.
Nick Fitzgerald convinced me that he was an honest and reliable guy. He initially returned every call I made, met my parents and assured me on multiple occasions that he could have the work completed within one week. I'm still paying the loan back (with interest) the roof continues to leak and the windows have yet to be replaced.
I've filed a compliant with The Better Business Bureau in Dallas and they have made several attempts to contact Nick Fitzgerald regarding the above referenced complaint. And regretfully he has not responded resulting in the closing of the complaint as Unanswered.
