Ripoff The $200 promotional agreement Nationwide boo boo rip-offs

On september 20th my partner and I ordered two I90s and service from Nextel. We received the phones on the 23rd, we then tried them a little for the next day or so, and decided these would not work for our business. So I got on Nextel's website and read the return policy.

I am going to cut and paste the part of the return policy that pertains to this situation. (The $200 promotional agreement cancellation fee will be waived if the phone is returned in like-new condition with all original kit components and packaging within 15 days or activation with less than 30 minutes of use.) So as it is written if the phone is returned within 15 days, we do not owe the 200 dollars.

So we then called Nextel and they assured us it would be no problem. We then sent the phones back. Three weeks later we get a bill fo 533 dollars, Which included two two hundred dollar early cancellation fees. I called Nextel and asked why we were being charged this much. He looked up our account and told me that one phone should not have been charged but the other one will. I then asked why, because we had returned them within 15 days.

I was then told that one of the phones had been used more than 30 minutes. I then proceeded to tell him that it did not matter because we returned them within 15 days. He then told me that is right but it was used more than 30 minutes. I then told him that is not what it said on the website, that it said 15 days or or activation with less than 30 minutes of use. He then told me it was within 15 days of activation with less than 30 minutes of use. I told him that is not what it said.

Needless to say this was getting me nowhere, so I then asked him who hi superior was so I could talk to them. He tol me to contact heidi. [email protected]. I contacted her the next day and told her the situation. She told me she did not see what I was talking about. I then cut and paste the phrase for her to read it. She then emailed me back saying yes it says:
(The $200 promotional agreement cancellation fee will be waived if the phone is returned in like-new condition with all original kit components and packaging within 15 days of activation with less than 30 minutes of use.), so you owe nextel 324 dollars thank you have a nice day. I emailed her back stating that it does not say of it says or or not of, or not of. And that this changed the whole meaning of the agreement.

That was the last I heard from her. The reason I returned the phones was because according to nextel's website I had 15 days to do so and after 15 days the phone had to have less than thirty minutes use. That is the way it is written and I do not think we should be responsible for Nextel's error!!!
