The following Statement was sent to the BBB and the Attorney General's Office:
We hired Mr. Hill, the owner of Digital Express Productions for our wedding on Nov 10. We entered into a contractual agreement on 10/25/06 for his photography services (reference #1 attached). The contract states the service would include; viewing the disc of all pictures, 50- 4x6,2- 8x10 and 8- wallet photo's for the amount of $1500.00. I wired Mr. Hill the full amount prior to date of wedding as required by him.
After the wedding and reviewing the disc of 550 photos taken we fell in love with many more pictures than the quantities mentioned above. I asked Mr. Hill what the procedure was for making our selections as we never received an official order form or price list from him. We knew that we would be receiving the promised photo's in our contract, but weren't sure how to go about it.
Mr. Hill then faxed me a single page (reference #2 attached) he instructed me to fill it out and fax to him. We made several selections with the quantities/size/color request and faxed him 7 pages (reference #3 attached). I explained to Mr. Hill that all 7 pages were the pictures we liked BUT since we had no idea what the price would be, I asked him to please provide us with the pricing BEFORE he spends any time cropping/editing, etc. He said "sure" and then mentioned various prices to me over the phone. Again, we were never given any sort of price list so the total amount was unknown at that time.
About one week later we received a fax with the total price for the additional photos (reference # 4 attached) it was $1,245.00. At this time we expressed our interest in purchasing the additional photo's but could not do so at this time. We explained that we would like to first receive only the contracted package photos and in the near future we would then purchase the remaining pictures for $1245.00.
This is when everything went bad. Mr. Hill told me that the 7 page fax photo list voided our original contract and unless we pay the additional $1245.00 we would receive nothing. Mr. Hill has continuously referred to our 7 page fax as an order. Nowhere do these forms read order and they do not include any prices or total amount due. There are no signatures, and therefore should not have been considered a contractual agreement.
Reference #1 is the only signed agreement and contract between us. Since this initial disagreement Mr. Hill has made many insulting remarks to us including accusing us of having no money and being spoiled. This is not the case; we only wanted to have the contract honored by him in a professional manner.
