Ripoff of Rollover minutes by way of fraud and deception

I recently purchased a new phone and agreed to a two year service arrangement with Cingular Wireless. I have had nothing but problems as Cingular's employees seem inept and unable to tell the truth or provide any level of reliable information that is honest or factual in the marketing of their phones, products, services, and in support of same.

I have been a customer with Cingular for years and had accummulated over 4000 rollover minutes in my account befor upgrading. Prior to upgrading Cingular's employees falsely and fraudulently made assurances that I would retain these minutes, however after upgrading the minutes are gone.

I contacted Cingular about the problem and was told that the company had decided arbitrarily to cancel accrued rollover minutes without any notice to customers when the customers upgrade or change equiptment or plans.

There are apparently no written disclosures about this policy in plain sight anywhere in the copmay's promotional or marketing materials or advertising, or other documentation furnished in writing to their customers that are clear and concise or specific enough not to be so vague as to be meaningless.

Nothing in any way clearly informative of this policy is mentioned anywhere on Cingular's website or in any written materials provided by the company to consumers post or pre sale nor are employees making truthful disclosures to consumers who are upgrading or renewing service agreements, in fact their employees are engaging in misrepresentation and fraudulent representations to the public of just the opposite of the actual policy and knowingly concealing this from the public in marketing and advertising and by way of oral misrepresentations.

I believe the implementation of the policy by Cingular is a fraudulent taking of something of value from the consumer without any consideration or compensation and I believe that the consumer has paid for these minutes and is entitled to have them availble as a matter of law and that any arbitrary change in the policy without the consent of the customer or for no value which change is for obvious reasons being undisclosed, underdisclosed, and otherwise intentionally concealed for obvious economic gain and unjust enrichment for the benefit of Cingular constitutes an unlawful theft from the customer.

I further believe that the method and mode of implementation of thsi policy violates state and federal laws against unfair and deceptive business practices and merits immediate administrative and judicial remediation as Cingular is obviously involved in a massive scheme to defraud customers and deceive them by misleading them in the normal course and conduct of business.
