All but called me a liar and a theif and actually called me nasty

In January I ordered a total Gym (exercise equipment) from the QVC home shopping channel. I sent them a check for $246.27. A few days leter I called and tried to cancel the order but was told that it was too late to cancel since the order was already in the system (whatever that means). I told the representative at that time that I would justcancel my check then not take the gym when it arrived. I had previously called ups and they had suggested I do this. The QVC rep said it was not their policy for me to do that. (She said not QVC's policy. She did not say it was against the law.)

On January 16 the gym arrived and I refused it. UPS left with it.

Afew weeks later I received a collection letter from Credit America (80 West Upper Ferry RD, West Trenton, NJ 08628) The letter informed me that Credit America was representing QVC and it further told me that I could be in serious trouble for knowlingly writing a bad check; along with some other hints of how if I didn't send QVC the money they would take me to court. I ignored the letter thinking QVC had not had time to processed the return.

A few weeks later I received another, even stronger letter from Credit America concerning this matter. At that time (Feb 16) I called QVC and talked with William (non of the reps will give last names) I explained to him how I never took possession of the package and asked him to call the tracking number into UPS and find it.in very rude terms he told me he knew where the package was. When I asked where, he said 126 Baclkhawk Rd Happy KY (my address) He never considered listening to my explanation or meeting me in the middle and agreeing to track the package and getting back withme. He just flat out said the package had been delivered to me and I did not send QVC the money. Well, that pretty much was calling me a theif and a liar. I became upset but remained professional, my voice did quiver but the only thing I told him at the time was that I never wanted anything to do with QVC again; for them to remove me from their membership, and I hung up.

Again on March 3, I received another letter from Credit America informing me they were recommending to QVC to take further action. I called QVC again and talked to a female rep (Idid not get her name) She had record of my previous calls to QVC. Again, my cries of innoncence fell on deaf but rude ears. She outright accused me of receiving the merchandise under fraudelent pretenses.

The next day, March 4, I called UPS and was told to tell QVC to call them with the tracking number since QVC's problem was with them not with me. Soooo I did. I spoke with a very nice, appolegic woman who said she would take care of the porblem and I would not be contacted again. I did not bother to ask her name because I thought the ordeal was over.

March 29, I received another letter from Credit America; same old story. March 30, I called QVC and asked them what did they find out when they tracked again. This time I got the reps name, Loraine. It was the worst. Right in the middle of my explanation again, she called me nasty and said I knowingly broke the law when I called to cancel the order because I had no intention of paying for the merchandise. I asked her why didn't they track the package since they were the ones with the tracking number and she said it was not QVC's duty or practice to track packages. She relunctantly gave me the tracking number.

I called the UPS company and in less than one minute I was told the entire journey of the package. Which was: January 16 delivered to 126 Blackhawk Rd, Happy, KY refused by adressee; delivered to the shipping dock where it originated from 1400 Raff Rd SW in Canton Ohio 44710 on January 18 at 9:32 AM and signed for by Ed Johnson. The UPS customer service rep assured me I did not break any law; I was within my right as a consumer; only thing I broke was QVC's policy.

Guess what? I called QVC back. The new rep (I did not get name again) appologised profusely and said I would not be contacted again. I am just waiting.

My problem with Credit America is that they have been harrassing me when it would have taken them a very short time to find out they had no case against me.

I have contacted my Attorney Generals office and a lawyer. I am not one for frivolous law suits but I am willing to do everything it takes to get get current or new legislation laws changed because I know I am not the only person being verbally attacked by big companies.
