Fannie Mae trying to sell property they don't own can't be legal, can it?

Fannie Mae foreclosure advertised through a REMAX office in west central Minnesota with a property they didn't legally own. Seven weeks into the nightmare working with Fannie Mae.

My offer was accepted on a property and contract signed. Inspection done. Cash ready to pay Fannie Mae. Had a title search done by a professional title company because I went and looked at the property description at the tax assessor's office and it wasn't the same as the advertised description through REMAX. Fannie Mae foreclosed on a mortgage with the wrong legal description.

Now they are trying to get the previous owner they supposedly foreclosed on to do a quit claim deed.

Now I'm sitting without the property, without my earnest money back and out of pocket for an inspection and title search for a property that shouldn't have been legally advertised to begin with.
