I ordered OVVIO Firm Anti-Aging Cream on 12-31-11 under the 14 day satisfaction Guarantee.
(You will be billed $3.95 for shipping and handling (non-refundable) for your trial period. You will have 14 days from the date of your order to evaluate OVVIO Firm Anti-Aging Cream, you will be billed $86.00 on the 15th day of your order. Lf you decide you are unhappy with the OVVIO Firm Anti-Aging Cream, cancel at any time during the 14 day period and pay nothing except shipping and handling. You can cancel at anytime via our customer support line 1-866-209-3653 or email us at [email protected].)
I called on 1-12-12 and canceled.
Then on 1-19-12 my visa card was charged $86.00
1/19 WITHDRAWAL @ TMGB*OVVIODAY.com 866 2009631 FLUS ($86.00)
I called the support number above and was told I had to obtain a RMA number and RETURN the product for a full refund. Or they would give me a refund immediately of $56.00 making the item cost me only $30.00.
I argued that I called in and canceled, and should not be charged except for the shipping and handling fee. I told them to look at the TERMS & CONDITIONS on their own web site at the section: TRIAL OFFER
IMPORTANT: If You don’t call us before the Trial Period ends, Your credit card will be charged 86 for the Product that was sent to You. Under all circumstances You will be responsible to pay the shipping and handling charges for Your Product. You agree that we can charge Your credit card for shipping and handling charges, and You will pay such amount (s) regardless of whether You cancel Your Trial or not. No refunds are provided for shipping and handling charges.:

Ok, This is where they get you - under the OVVIO Skin RETURN AND REFUND POLICY - (You can return your product within 30 days from the date of order for a full refund of the purchase price less the Shipping and Handling Fee. Shipping and Handling is non-refundable. To return the product, you must obtain a Return Merchandise Authorization number (RMA) from customer service by calling Toll 1-866-209-3653) - also you will see this — (Your credit card will be charged for the full purchase price 86 until we receive your product back. Once the product is received and checked by our warehouse, we will issue you the appropriate refund. Please allow up to 3-5 business days for credits to be reflected on your credit card statement after we receive your returned merchandise.)

Two sentences here bother me.
1. You can return your product within 30 days from the date of order for a full refund of the purchase price less the Shipping and Handling Fee.

2. If you decide to cancel, please send back the product to:

The above sentences with "You can return" and "please send back" & do not in my opinion warrant a mandatory return.

In their Terms and Conditions on the web site
UNDER the 14 day satisfaction Guarantee. &
the TRIAL OFFER section— this company should not be allowed to charge for the product if canceled in the allotted time.

So, is there any recourse avenue that one can take to make a company honor their own terms for these free trail offers?
