Late fees charged after I was approved for and had paid for a skip-a-payment

I contacted M&T Bank on 1/18/10 concerning a skip-a-payment option they have on loans. I was given information and specific instructions on how to apply, which I followed. During the conversation I asked if I would be assessed a late fee since my loan was due and I was told no. My husband called back M&T on 1/23/10 and was told he was approved. I called back later that morning and paid the $50 fee via check by phone. I checked our account several days later and saw to my surprise that we were assessed a $32.40 late fee on 1/25/10 two days after the skip-a-payment was approved and paid for. I called M&T upset that they charged me the fee. I was spoken to rudely and told it takes two days to process the skip-a-payment fee and that's why I was assessed the late fee, this was the first time I had EVER heard that it takes two days to process a payment. I asked to speak to a manager. The manager said she would have to review the conversation to see if I asked about a late fee. She called me back after her review and was rude and said I didn't ask about a late fee and they would not reverse it and hung up on me when I told her I was going to report them to the BBB and the NYS Department of Banking. I would have never paid a $50 fee if I was going to be charged a late fee on top of the skip-a-payment fee, it defeats the purpose. It is ridiculous that it would take two days to process an in-house payment. I feel I should not have been charged a late fee when the skip-a-payment was approved and paid for. I was never told that I would receive a late fee when I paid the $50 fee or that it takes two days to process the fee. M&T Bank are crooks in my opinion, they charge fee after fee and feel that they can get away with it because you are locked into a loan. I have reported them to the NYS Department of Banking and want to warn everyone out there of their lack of ethics, customer service, and crooked business practices.
