Conn's Return & Exchange Policy

I contacted Conn's to apply for credit for an window air conditioning unit at 4:00 pm central time to store #87. I was advised of my credit limit, which include zero down.

I preceeded to the store to purchase a unit for a "specific purpose" that was to cool a portion of home until my a/c unit was fixed. I meet with the sales lady to pick out a unit, when another sales lady introduced me to a portable a/c unit (8,000k btus).

I decided to purchase 2 units on my new line of credit, after re-assurance from the sale ladies that the portable ones were more efficient and a good purchase and the units would surely cool my rooms up to 600 square feet.

About 1 hour later I called back to the store and informed the sale ladies that the units were not serving its original intended purpose (to cool my rooms) and the units continued to trip my circuit breaker.

I informed the sales lady, that I was going to bring them back. I arrived at the store with the units, and the assistant store manager refused to take them back due to their return & exchange policy (even though I only had them in possession for 1 hour).

The units kept my rooms hotter than they original were and continued to knock my breakers out. I have called their corporate office and still have not received a return call yet.

What the sale ladies have essentially done is created an implied warranty of fitness for a particular purpose by insisting that the portable units were a better buy.

Conn's is just that a Conn. They have written in their additional provisions that there are no warranties express or implied of fitness for a particular purpose with respect to goods and service sold.

Thus avaiding the laws of UCC. UCC laws were meant to protect the consumer. If companies are alllowed by law to add particular verbiage to their contracts (in which they know consumers have no recourse) then who is the law really protecting?

I still plan on exposing Conn's and taking them to small claims court for the merchandise.
