Didn't honor security deposit refund

We rented a house from McGinnis Property Managament in July in Colorado Springs. We moved out of that house on Oct 5th, at McGinnis's request because the owner had sold the house. I have a number of complaints about this company.

1. We mailed our rent monthly. One month, the manager, Wayne, showed up at our door and asked my wife for the rent. She told him she had mailed it. He yelled at her and said he didn't believe her. It was later discovered the check WAS at McGinnis the whole time. He verbally abused my wife and never apologized for this incident. Wayne also called my work and verbally abused me. I had previously asked him NOT to call me at work. We hand-carried the rent to their office after that.

2. When we were shown the house, we noticed a number of defects, including a broken Microwave, broken wood molding, dirty and stained carpets, and the entire yard was dead grass, dead trees, and weeds. The weeds were waist deep in the back yard, and there were piles of trash everywhere. We were told of course ALL these things would be taken care of quickly. They sent a guy over a few weeks later who glued a piece of splintered molding down on the stairway so it wouldn't stick out and hurt someone. It was still splintered, but glued down. None of the other items were ever fixed, even after repeated calls. We were instructed by Wayne to 'care' for the dead grass.

3. We kept getting calls every month or two from a company that said they were contracted by McGinnis to come work on the sprinkler system. The house had no sprinkler system, (and no grass). We repeatedly told them this, and asked them not to come, but they kept calling. When we moved out, we told them to go ahead and come fix it.

4. We were repeatedly billed additional charges and fees that would get removed when we called, and then somehow reappear the following month. This took almost a year to resolve.

4. When they put the house on the market, we were asked to stay until it was sold, and if we would, we would get 45 days notice before we had to move. When the house sold, we were given notice we had to vacate the house within 30 days.

5. When we moved out, we were told we would NOT get our deposit back for 60 days, and they would take out an undetermined amount to have the carpets proffessionally cleaned. This was in very small print on the contract, and was never mentioned when we rented the house. I would NEVER have agreed to this. Our new landlord, of course, was not willing to wait 60 days for us to pay a deposit on the house we wanted to rent. We had complained the carpets had not been cleaned when we rented the house, but I'm sure the previous tennant would have had the same contract.

6. We have been calling their office to try to get our deposit back. I have been hung up on, repeatedly sent to a voicemail box that has long been overflowed, and been promised return calls, never to get any. They have also told me they were understaffed, so they checks were delayed, then they started telling me the check was in the mail, it finally showed up just under 60 days after we moved out.

7. We paid for utility service after the date we moved out because McGinnis would not return calls to the utility company. I belive they get so many complaints they don't return any calls, period. Susie at the Colorado Spings Utility company told us they would not return calls so they had to bill US until the next tennets registered with the utility company.
