David McDavid Honda, Post Dated Checks and Dishonest Dealings

On October the 16th, I purchased a 2007 Honda Accord LX. As part of the agreement for the purchase of the vehicle a check in the amount of $500.00 was written as a part of a down payment. It was the agreement between myself, the salesman, Rodney Jackson, and the dealership that this check would be held for 3 weeks. The check in question was then post-dated for November the 6th, as instructed by Rodney Jackson. The check was then deposited not 3 weeks later, but 2 days later.

In response to this dissolution of an agreement I went back to the dealership where I spoke to Rodney Jackson as well as our finance manager Jae, where I was informed that the accounting office was closed and that when they opened back up on Monday morning I would recieve a phone call from Rodney, and the likely event would be a refund check in the amount of $500.00.

To my astonisment on that next Monday morning we recieved a call claiming that they would be glad to pay us in check or in cash $25.00 or whatever the amount may be for repayment of a bounced check. However, the check did not bounce. It was not $25.00 that I was wanting.

In response to the question "what is it going to take to make you happy?", I exclaimed again "A check for $500.00 and on November the 6th I will gladly come in to the dealership and write them a check for $500.00 in accordance with the original agreement."

After recieving the "run-around" from the dealership for several days I finally tried to contact the general manager of the dealership. I was told he would be in the following Tuesday morning at 9am, then I was told he was in Las Vegas on vacation for another 2 days. I finally reverted back to our salesman Rodney Jackson due to continuously being told by several different sales managers that they were not aware of the problem at hand.

I told Rodney that I knew he was not the exact person that I needed to talk to, but that he had more of a grasp of the situation, and that i would like to be contacted by someone within the next 24 hours or I was going to contact my lawyer. I recieved a phone call from the Customer Service Manager of David McDavid Honda named Barbara. After a 15-20 minute conversation with her, and still being dissatisfied, the end result was her telling me that the only person who could authorize a repayment would be the general manager, who still was out of town. I was told to be expecting a phone call from the general manager to resolve the issue further.

To date, 4 days later I have not recieved a phone call from the General Manager of David McDavid Honda, Irving. I am understanding of the processes involved in writing a post dated check.in conversations with my bank, as you may well know, a post dated check is just an extension of credit between a company and an individual for merchandise. The banks main concern is only for the proper funds of the post dated check to be available upon writing the check, and not necessarily the date of the check.

I feel in dishonesty this extension of credit was disregarded and a violation of an agreement for an automobile purchase occured. After filing a complaint with another agency I recieved a phone call from Barbara Einsohn and all that was offered was an excuse for a mistake and that nothing could be done to help me any further after she talked to the general sales manager, John Pheylan.
