Incompetence or Fraud?

I bought a 2008 Honda Civic Coupe LX from David McDavid Honda in Houston in July. I also bought the optional LoJack Stolen Vehicle Recovery System. My car was stolen in December and after many frustrating phone calls to the police, LoJack, and the dealership, I found out that LoJack was never installed on my car. Most car dealers do not install LoJack at the dealership, but send your paperwork to a third-party authorized installer.

After they receive the paperwork, they are supposed to call you and make an appointment for the installation. I never received a phone call and the Houston LoJack installer has no record of my paperwork being faxed to them. For McDavid Honda, this is either total incompetence (the director of finance said their fax machines only give them confirmations if the faxes don't go through) or fraud since the $700 I paid for LoJack went somewhere.

The police found my car last week in pretty bad shape. I have filed a BBB report demanding that McDavid Honda reimburse me for all the costs associated with this problem and have received no response. Even though they told me they would reimburse me for the cost of the LoJack (which I don't think is enough since if it had been installed in the first place, the inside of my car wouldn't have been wrecked by car thieves), they've done nothing to do so. I'm now in the process of getting a lawyer to threaten McDavid Honda.
