Ripoff horrible experience

To Whom It May Concern:

This letter is to explain my experience with David Mcdavid Honda in Irving TX. From the first day visiting the dealership on July the 28th it has been a horrible experience. I was in the Market for a new car; I decided to go with a Honda. I called a few other dealerships in the area checking prices and discounts that they were offering.

I spoke with Mike Akels at David McDavid, he insisted on me coming in to talk about a new car. On July 28th at approximately 6:00pm my fianc and I went to the dealership to talk about a new car. I had no intentions on getting a car that evening.

I talked with Mike Akels for a couple of minutes, and he turned me over to Ty Patterson, a salesman. We drove a car and talked about prices and payments, as usual. They appraised my trade in. We were at the dealership for so long that my fianc had not eaten, her blood sugar had dropped and was not feeling well. I told Ty Patterson about that and he just went on with what he was doing. They would not give me the keys to my trade in so that we could leave.

I finally talked to Mike Akels and told him about my fianc not feeling well, he said that it would be just a few more minutes until we were finished, that he would go get her something to eat if we wanted him to.

She said no that she would be ok if it was just going to be a few more minutes. An hour and a half later we were in the finance department office.

I told the finance guy that I did not want to do anything tonight with getting a new vehicle; I needed to leave and take my fianc home so that she could eat and lay down. He left and brought Mike Akels into the office. Mike Akels then again said that we would only be there for a few more minutes. I told them that I wanted to leave that I was not ready to make a deal tonight, I needed the keys back to the trade in so that we could leave. He said, why do you want to leave we have met everything that you asked for. I told him again that I was not ready to do it; I wanted some time to think about it. I still never got the keys back. Finally the finance guy said that if he could get my payments below what I wanted would I go ahead and do it tonight. I said fine; let's just get this over with.

Mike Akels said ok and left. We were getting the paperwork signed and out of the way. I did not have the checkbook with me at that time, because I did not want to make a deal that night. So I asked the finance guy if I could drop a check off the next day, post dated for the 16th of august to cover the down payment and the 1st month lease amount. He said that would be fine. Another hour later we are setting in the lobby waiting for them to bring the car around. Finally we were out of there after 10 that evening.

The next day I called Mike Akels to ask him about some of the specifics on the lease. We actually had an argument about the lease. The night before he had told me that since it had taken so long for everything that they would pay for the TT&L. I saw no place on the lease that this had been done, it had all been rolled into the total price, we argued about it for a few minutes, and then I asked to talk to the finance guy. I talked to the finance guy, and we argued for a few minutes, I told him that I would rather just cancel everything, and I would come pick up my trade in, that this was not good business. He said that I could not do that, once the lease was signed it is final.

So I thought that was all I could do. So I wrote out a check for the amount owed, post dated for the 16th of august. I took it in to the dealership, and was not able to talk to anyone; they had me wait at the front, and took the check from me there. They had all of my belongings out of my trade-in in a bag waiting for me there. I did not receive everything, because they would not let me clean it out.

August 16th, I had checked my bank account to see if the check had gone through ok. I then noticed that I had an overdraft fee on my account from the dealership running the check through on the 14th instead of the 16th. I called the dealership and talked to Mike Akels again, and he transferred me to Jerry. I told Jerry about this, and he said that he would send me a check to cover the NSF charge, and run the check through a second time. I said that would be fine. October the 14th 2003 I received a letter from David Mcdavid that my check needed to be paid for and picked up within the next 10 days. I called and talk to Regina Persley, I told here that the whole amount was not in my account that I would come in and pay half of it, and the rest on the next pay period to get this matter resolved. She said that she would ask if I could do that and call me back. I never received a call from her. I called back a few weeks later and talked to Regina again. I asked her about getting the check taken care of, she said that she didn't know where my paper work was, that it was not sitting here in front of her. Time goes by, and I had forgotten about the check, because of the holidays, and other family matters.

March 2nd 2004 I received a letter from the state of Texas that there is a warrant for my arrest, because of this check. I called the office that I received the letter from, and they said that I needed to come in the office before the end of the week. I called Mike Akels at the dealership, and told him about this, he transferred me to Donna. I told Donna what was going on, she was very surprised. She talked to Regina, and Regina said for me to come in and pay for the check, and take the receipt to the Dallas county office, and that the warrant would be lifted. That evening my fianc and I went to the dealership and paid for the check with a cashiers check. After it was paid we talked to John Pheylan. We told him that this was not right for me to go through all this because of the dealerships mess up. He asked me what I wanted him to do. I told him that I thought some compensation was in order for all the trouble that has been caused. He said that there was nothing that he could do, that he would call me back the next day after he talked to the General Manager.

The next day I never heard anything from John Pheylan. I called him and left him a message to call me back, I never received call back. I left a message for Jerry Lovins (GM) to call me back, he never returned my call. March 4th I go into the Dallas county office to take in the receipt, and they tell me that I have to pay $169 in court costs and will have a court date, the warrant was lifted. I call the dealership and left another message for Jerry Lovins, and John Pheylan to call me back. I still never received a call back from them. I called the dealership and ask for Mike Akels, he gets on the line, and he said that he would give John Pheylan the message, and have him call me. I still did not receive a call. March 5th I call and ask for John Pheylan, and he answers his line, and he says that there was nothing that he could do, that if I wanted to go above his head that I would have to talk to Barbara Einsohn the customer service specialist.

He transferred me to her, and I explained the story to her and faxed her copies of the check, the letter from Regina, and the letter from Dallas County. She said that if she was not able to call me back today, that she would call me back next week before Friday. I called on Thursday March the 11th and left Barbara Einsohn a message. I called Barbara again on March the 12th and left her another message.

Barbara called back about an hour later, and apologized about her not calling me back the day before. We spoke about the options of the dealer buying back my car, and letting me taking my business elsewhere. Barbara said that she would talk to the appropriate people and see what can be done.

I am at the point where I think that it would be reasonable for the dealership to buy the car back and let me take my business elsewhere. I spoke to Barbara today March the 16th, she said that she had not taken it further because I said that I had an attorney, and was wanting the dealership to buy my car back. That was not what we had talked about on Friday, I think that is was misunderstood. Barbara did say that the dealership buying my car back was not an option. I told her that I thought it was fair for them to buy the car back, considering that they provided me a service, and the service was not to its fullest. I told her that the money that they would be losing from buying my car back, would not be anywhere close to the amount that they would be losing, after I mailed this letter to the attached list of people, and media. She agreed and still said that buying the car back was not an option. So I asked her, then what are my options? She said that she was going to talk to Jerry Lovins, and get back to me.

I called and left a message for Barbara to call me back on March the 19th, she did not return my call. I called again on March the 22nd. I talked to Barbara and she said that there was nothing that they could do.
