Robert Schell is a ripoff, he agreed to purchase my dead mother's house at set price and is now backing out of deal.
My mother died January 9. Her neighbor, Robert Schell, of six years said he would like to buy her house. He buys real estate around the town of Altura and he knows what he's doing. He lives right next to her house.
He looked through the entire house and we told him we would like $56,000 for it. He agreed to this price and sent us earnest money; a check for $1,000. He told us he would rather we didn't tell everyone because it's a small town and he didn't want the rumors to start. He told us we could tell others that called that it was sold.
Other people called, but we told them it was sold. We had the earnest money so we thought it was a finished deal. He has stalled the closing, which is draining the small amount that I would inherit. He insisted on taking one last look through the house and now he claims that one corner of the garage is unstable and going to fall in. He doesn't want to pay the price we agreed to. He was smart enough to not sign the purchase agreement. I trusted him because he was my mother's neighbor and I never thought someone would take advantage of someone else who just lost their mother after an eight month struggle with cancer.
During this whole time, he took it upon himself to burn down some trees and bushes that were in the backyard as if he already owned the house and now he's not sure if he wants to buy it. He's trying to stall again and I can't sleep, eat or take care of my three year old son because of this stress.
I tried calling all the other people that were interested in the house, but they found other houses and now I have no one else who wants to buy it.
Please help me. I don't think $56,000 is a lot to ask for a house. He agreed to that in the first place and a purchase agreement was drawn up, which I signed. I can't afford to hold on to the house any longer and I lost my mother. I just want some justice. Thank you!
