November... $18.95 was charged to my credit card from webcapades. I did not catch it. December another $18.95 from webcapades was charged to my credit card, I still did not catch it. January another $18.95 was charged to my credit card. This time I saw the charge and called the number spoke to a Lisa. I told her this was not my charge and that I did not know how it appeared on my credit card.

At this point I did not know what this service even was. I asked her to remove the charge and she got very defensive, very rude, and evasive. I got no satisfaction and it was clear that they were not going to remove the charges voluntarily. I then contacted my credit card and filed a claim for freudulent charges. I filled out the affidavits and proof that this was not my charge. I was subsequently given a credit for all 3 of the $18.95 charges. I thought the matter was settled.

April I got a letter from a collection agency on a lawyers letterhead claiming I owed web capades $345.00 and that I had 30 days to respond or show proof that this was not my charges.

I contacted my attorney for legal council. He wrote them and copied my credit card company a letter demanding they show proof that these were indeed my charges and gave them 30 days to respond just as the threatening collection letter had given me. Also enclosed was copies of all of the papers, affifdavits and corespondance that was sent between my credit card and me.

This letter also specifically stated that no responce in 30 days signified that they accepted the proof and that these were not charges made by me. 11 days later they signed for the certified letter, so I know it was received by them.

This was also filed in US District Court as a matter of being a legal document in the event it was ever to be needed in the future. The 30 days passed and the collection agency did not respond. Again I though the matter was then setteled once and for all.

June (13 months later) I get another letter from another collection agency... My attorney is repeating the process of the previous letter noting that this had already been done with one collection agency. Although this has already cost me more than the $345.00 in attorney fees, I am considering filing a lawsuit against Webcapades to recoup my legal fees. To date they have not attempted to place anything on my credit report.
