I recieved an e-mail last December from Pat Mitchell @ eroticy.com telling me that my credit card company had sent him documentation that my membership charges were disputed.
To quote exactly:
"Please be advised that we have received notification from your bank of your claim that Eroticy.com/WebCapades Inc. Has charged your credit card in a fraudulent matter and that the card or card number in question was either lost, stolen, or otherwise misused without your authorization. Pursuant to our terms and conditions, and to comply with our corporate policy, we have fully investigated this matter and found that this is not the case. Please find below the information that we have collected from our database, logs, and documentation.
THE BEST PART IS HERE:
This email will server as notification of this violation of our mutually agreed upon Terms and Conditions. If this matter is not resolved, we will take further action which could include filing a complaint seeking civil damages of $25,000 plus legal fees and court costs, notifying the Trans Union, Experian, and Equifax credit reporting agencies of your forfeited debt and pending liability, and establishing an outbound telemarketing campaign in attempts to resolve the matter.
We will accept your settlement of this matter WITHIN TEN (10) DAYS OF THIS EMAIL by form of a money order or certified check in the amount below sent to the following address:
The issue is that I NEVER reported any dispute with my credit card company. The charges were delined because MY CREDIT CARD WAS OVER THE LIMIT.
I have made several attempts to resolve this with the people at Eroticy.com. When I called customer service for an address where to send my documentation the, very rude, customer service girl would NOT tell me. I asked for a FAX # and she wouldn't give me that either.
My credit card company has sent documentation explaining that I NEVER reported a fruadulent charge and it was completely ignored.
Now, I have a collection of harrasing e-mails and letters coming to my house threatening me with a $25,000 lawsuit OR send a cashiers check for $553.65 and it will all go away...
Since I have proof that the charges were declined for being over the limit on my credit card and NOT because I filed a fraud claim, and the people at Eroticy.com absolutely make it imposssible to submit my proof, and in return threaten me, then I will have to look at this as an extorion attempt.
Also, this Pat Mitchell guy has been sending his collection e-mails to my employers general mailbox so all of the employees at my job can see them. I believe this is done on purpose to futher bully me and humiliate me into paying.
Think of how I felt when the CEO of my company called me into office to explain. I thank god he offered to let this matter be handled by the company attorney's if it continues.
Here's the irony, The company's attorney's are based in Florida -
I have contacted the District Attorney's office in Palm Harbor Florida for help... It's a start
