Notify the FCC - Direcway should be investigated for FRAUD Internet

The letter I sent on 5/5/04 reads:

I have been caught in a service nightmare.

Direcway advertises High Speed Internet Access - they deliver slow access and often NO ACCESS. When the access fails the consumer is expected to spend hours, sometimes days on the phone just to get the poor service up and running again. I have spent as many as 3 out of 5 days on the phone with Direcway Tech Support, which is in India and often the language differences make communication difficult.

Even the installation was a nightmare - the Direcway representative made several mistakes with the installation, we had to hire an outside source at our expense to correct the errors and get our computers working with this degraded service.

I have been billed more that $100 a month for this service and can't get my email, can't use messenger services, can't drill down through web sites (no paging) and can't upload files (my system crashes) and this is how I make my living. I simply can't support my customers, obtain new ones, communicate with co-workers or function on the internet in any reasonable form. Dial up service at $10 a month was far better.

I have canceld my service, returned my equipment (per Direcway instructions) and just got charged $690.32 on my credit card from this company.

No one should have to stay in a contract with a company that cannot deliver the services they claimed they were capable of delivering. This company lies and lies and gets away with it and then goes on to ruin the credit of good, honest people who simply live in areas that either have dial-up or Direcway.

Is there anything that can be done to stop this company from taking advantage of so many consumers? They need to be made accountable. I have researched Direcway complaints on the internet and was amazed at how the same story about this company is echoed over and over. Please take a look at usacomplaints.com and search Direcway. Each complaint is the same story, retold in the consumer's words.

How can this company be forced to stop what appears to be fraud, false advertising and punishing consumers who seek a reasonable resolution? Is this company under investigation? Is there a class action suit pending?
