Fraud with ebay customers

Digitalcorp (d & Y distributors) obvious fraud with ebay business

I bought from Digitalcorp (also using the name d & Y distributors) through ebay a digital SLR kit Nikon D80 December 9th (US $ 1.108,99 including freight)
As they mentioned Paypal/Visa as their favourite payment method I paid immediately, not knowing that there is a Problem with acceptance of confirmed addresses from Europe in the USA. Digitalcorp returned my payment twice. So I went to my bank and transferred the money directly to the account of Digitalcorp.

I was a bit surprised because their customer service was not giving the impression that they are interested in helping me and the tone was much ruder than in usual business life. My e mail questions were not answered. And also when I asked if the received my money there was no reaction.

Based on this I gave a negative feedback in ebay hoping that would make them move. I can tell you it did!!! Unfortunately not the way I hoped.

As mentioned if you do not remove your feedback you will be waiting a very long time for your package this way your feedback will be true otherwise there is no urgency on our part this is not a threat but pleae understand wehn we recieve a bad feedback for no reason now you just give us a reason to justify the feedback

A phone call later the same day was an unique experience in my businesslife. His rude tone he was shouting all the time - basically said the same as above. If I would not take back my feedback I would loose my money without getting what I paid for. Even I felt being blackmailed, I accepted his offer to make an express shipment the same day and took back my negative feedback. Rating has been withdrawn mutually as it is called in ebay.
You might imagine what happened nothing from Digitalcorps side.

Early January after I have chased them again and again, as well by phone and e mail. I have set a deadline (January the 11th) after this date I will take legal action against them. To be prepared for this I had a deeper look into all available information and found beside this site here lots of other message-boards where other people reported similar experiences with this company. Parallel I made contact with ebay because I believe that powersellers like Digitalcorp cant be in the interest of ebay.

Considering that beside 455 negative feedbacks they have 833 mutually agreed withdrawals their rating with 98% positive feedbacks cant be the true picture. To be honest, I also cant understand how people 2 month after buying can rate positive. Or others write a bit slow or rude cs but rate positive.

8th of Jan I made a short reminder to them regarding my deadline 11th reaction came surprise, surprise, within ten minutes: Your shipment left with Fedex Jan 3rd You will receive a tracking number with automated mail shortly thereafter Today ist the 10th and no wonder no tracking number no delivery. No reaction on emails chasing the tracking no.
Help from ebay. We are acting. But we wont tell you.

Result 0. No payment return no delivery. I'll report the fraud.
