Replacement iPod Failed Again, Then Claimed Customer Damaged It

Not two weeks after my daughter received back her iPod for the second time, we had to return it. "Sad Face" icon again. I got a call today claiming it was damaged by customer. Claimed there were scratches on the front of it and dents on back.
