My wife (single Mom of two at the time) ventured savings and credit cards to start a business. Soon after embarking we were approached by a vendor calling itself Bank Services, Inc... Or Bank Services promising to furnish a credit card machine for the business.
They were seemingly honest and repeatedly responded to the "how much" question with "$35 a month"... That was the complete, total and incontrovertible sum of their services. Not long after the initial greeting we received follow up, high pressure phone calls from this vendor and LeaseComm (whom we had never consented to nor even met) and were told that we needed to sign a contract for the machine and that someone would call for the info and we were to simply say "yes" to everything and sign the contract at the time the machine was delivered or the entire process would come to a screeching halt an we'd never get the service we sought.
My wife was threatened with delays and a sense of immediacy by the Leasecomm rep to sign the blank contract when the Fed Ex guy came to the business because he would not leave the box without it and we would never be up and running in time for grand opening. Well, the Contract was blank with no critical terms filled in such as price and there were yellow arrow stickers where she was to sign.
My wife signed the contract though NONE of the terms were ever explained... And again were assured that the fees would total $35 per month. This was Leasecomm's popular UNCONCIONABLE AND DUPLICITOUS and they term it.."non-cancellable" document.
This company makes its millions from these deceptive business practices and preys upon the law abiding businesses and private communities of our country. We immediately began to see astronomical debits ripped from our checking account from sources we had never sanctioned nor even consented to by any means... It was well over $100 per month and climbing every month.
We sent back the machine (certified mail/return receipt requested of course) immediately and closed our account to stop the wire theft from Leasecomm. They have chosen to file suit against my wife in their own back yard of Middlesex County Mass. Their contract purports to waive venue and objection thereto as well as a jury trial... This document also included obscure non colloquial jargon of personal guarantees... None of which was ever explained to any degree by Leasecomm nor any of its agents or associated vendors.
It would appear that these lawyers for Leasecomm may be looking for the truly unleveled playing field and perhaps this forum may be more than friendly to this corporate parasite than unbiased jurisprudence would normally afford.
It is NOW the time to fight. I welcome any and all information about a possible Class Action Suit against Leasecomm and seek justice for all those bereft of their savings and livelihood.
