I signed a 48 month contract with Leasecomm on 5/18/1999. This should have expired on 5/18. They were still taking $84.48 per month from my personal checking account until November 17. They sent me a bill in January for nonpayment and keep treating me like a lawbreaker.
I fulfilled the 48 month lease and don't owe them a red cent. I spoke with an Austin Attorney. After looking at the Federal Trade Comission complaint, he said that Leasecomm could be sue for Breach of Contract, Fraud and Deceptive trade practices. He also said that as an individual I could not afford to prosecute legal action, but he is willing to join a class action lawsuit with other attorneys against Leasecomm. Per his advice I have sent certified mail to my contact at Leasecomm which gave them 30 days to refund my money, cancel the lease, send a letter saying the account is settled and that I don't owe them any money. I also warned them not to post any negative credit information.
If this fails, does anyone know of any current class action lawsuits that are being filed against Leasecomm? I would appreciate any information that you have
