Complaint / Review
Ocwen Federal Bank
Ripoff, fraudulent possible

In 1997 I traded in a mobile home for a new one. Last I heard of it. I got a divorce and ended up in bankruptcy court. This home I had traded in I didn't put on the bankruptcy as I didn't know there was a problem.

In Feburary my ex got a call from them about a delinquent note. This is 7 years later. Actually he got a letter about the house being repo'd. He thought it had to do with the house I had let go in the bankruptcy as did I. I got letters last June from them. And at this point I realized they were talking about the old house. Why is my name on it I have no idea.

I never received anything in all that time about payments being behind or anything nor did my ex husband. When he asked for proof that the house had actually defaulted, they only sent him the papers we signed when we brought the house. No other payments. No other papers. They told him the house was sold already, they told me the house was missing. We both got different stories everytime we talked to them. They took some of his tax return money. I talked to them a few times on the phone and actually said I would try to figure out what was going on and if I was sure this wasnt a mess up what would I have to pay.

They said they wouldn't take 400 a month. Then they began to garnish my wages. I live in texas where the only reason you can garnish wages are taxes, child support or student loans. HOw did they manage to garnish my wages. Does federal law take over state laws? What about State rights? If they made it into a tax is that not a fraud this is not a tax. But how else can they garnish my paycheck. I was never formally served on this either.

I do not know much about the law but I do know this seems fishy I don't even have proof the house was not paid for. I have gone to lawyers they all seem nervous because of the federal government though they all admit they do not know how they are garnishing my wages. DOes anyone know what I should do in this situation?
