On May 25 at 6 pm I met with a rep from National Floors Direct and he showed me carpet samples with no specifications about face weight, fiber type or construction on its backing or sample board. I didn't have the Home Depot sample with me to compare but and he couldn't tell me the specs on his. I told him what Home Depot's specs were and he called his supervisor who told him theirs was a couple ounces heavier after knowing what the competing carpet specs were. I was leery of their specs but I signed on with them knowing that I could cancel within 3 business days and get my deposit back.

After looking at my Home Depot sample later on, I realized the density and height was smaller and I called them on May 29, the first business day after Memorial day, to cancel and they said they would start on the cancellation right away. I also sent a copy of their cancellation form to their address by US Express Mail since they don't accept fax and I wanted to make
sure they got it the next day. The cancellation form was returned to me on June 8 by the post office because they refused to accept it twice. I called them about the cancellation and asked them when I would get my refund and they said 15 business days. They called me back later to make sure of the name and address since it was under a realty trust name and not an individual name and said I will definitely get my refund.

Towards the end of June I called them again and they said they are behind in getting out refunds and would email accounting about the refund. I kept calling them multiple times in the weeks after and then they said they would send a check out July 22nd. I called in beginning of August and again on Aug 10 they say all they can do is email accounting. Even when I said I
would contact the attorney general's office they said to go ahead.

I contacted the attorney general's office and they said they don't deal with business to business dealings and that I should go to court or maybe send them a 93a letter. I guess because NFD knew I wasn't an individual consumer that I would have to go to court and that the attorney general could not help. So don't think that because they say you can cancel and get
your deposit back that you will get your deposit back. Put a stop payment on the check immediately as well as cancel your order.
