30-year Old AC that stops working has not been maintained?

We have had a home warranty on our home since it was purchased in 2005. We were given the home warranty by our realator for the first year because the house was 30 years old and the AC was original to the home.

When our AC went out the first summer, we were told there may be a leak in the freon since when the freon was filled it began working again. The next summer, it went out again. Technician said it was freon and that unit needed to be cleaned so we had it cleaned.

This summer, it went out again. First technician said freon. Four days later it stopped working. Second techincian said it needed to be cleaned and had a crimped lineset so it wouldn't be covered. We got a second opinion and this guy says the com pressor is bad, it was not a result of lack of maintenance on out part and that he was recommending AHS replace it.

Three days later no word from AHS. We call and they say the technnician has yet to file his report. Rest assured they say. I say it's 100 degrees and I have a 9 month old son, we have to stay in a hotel, can't you get them to submit it? No they say

Friday (three days later) still no word. I call AHS again and they claim still no report. I express my concern, they say be patient and say I have because I still have no AC and it's hot and my son has a respiratory condition.

Return home from work to find a message on my answering machine: AHS is telling me they are denying my claim because the technician reported that the unit was dirty, had a crimped lineset and was not working due to lack of maintenance.

The kicker is when the second opinion was sent out, AHS told me that if the technician determined it was the same problem, we would owe the $55 service fee. If not, there would be no charge. Funny how the techn ician didn't charge us when he gave us the dignosis.

AHS acually told m e they thought the technician must have lied to us to avoid confrontation. I told them had they just told us then that they weren't going to cover it we would have had it replaced on our own an dnot stayed in a hotel and bought a $300 portable unit. They didn't seem to follow that logic.

I canceleld my policy today and I am subseuqently filing complaints with any other consumer industry that will listen.
