In May we leased a home with a purchase option, the owners are a real estate agent and mortgage broker. We paid 5000.00 down and the first payment of 975.00. Three weeks after moving in we were served with a foreclosure notice. We discovered that the owners Gina and John had not made a house payment in six months. We got a lawyer and had a new contract drew up to where we would make our payments to the linder Litton loan instead of the owners to insure that the mortgage was being paid. As per the contract the owners Gina and John were to pay an additional amount to catch up the payments. We have several E-mails from the owners stating that the payments were caught up and demanding we pay them the rent money owed, instead of to the lender.
October our home loan was approved and we were set to close the first week of November then we find out that there were a total of sixteen thousand dollars worth of liens on the property (they never disclosed to us that they had liens on the property) and that the house could not be sold until the liens were taken care of. At this point all that Gina and John could hope for was a short sale, which usually takes months to get approved.
Then in December we got served with a Notice of Sheriffs Sale to auction the house off on January 29th. We waited until after New Years before we even started looking at other houses. The short sale was approved mid January on Gina and John's house but by this point we had already signed another purchase agreement on another home 2 doors up the street. We had already paid money into an escrow account and had the appraisal done. Our delima was stay where we were or move on and we chose to move on.
Gina and John were plesant up until they found out that we had chose to buy another house and then they got NASTY and bitter...
January 25th they showed up begging us to buy their home and we refused, January 26th they came to the house with a sheriffs deputy to do "Quote" a walk through, making false accusations that we destroyed their home and kicking our packed boxes along their way. Claiming we stole a swing set, busted the water line and sooooo on, it amazes me that the water line that we fixed, the one they had taped up with electrical tape was the one they accused us of busting on purpose...
January 27th they showed up demanding that we evict the proterty by eight that night and I was like we will be moving out on the 28th, the day we close on our new home, and Gina was like no tonight or I'll come by with a sheriffs deputy and have you put out, and I was like what ever!
So later in the day she shows up with a deputy demanding that we be arrested for stealing her 500.00 swing set and the deputy was like that is a cival matter. Then she began demanding they remove us from the property, (remember this property was being auctioned off on the 29th.)
That weeked the 25th, 26th and 27th we had the Clark County Sheriffs department at our home four times because of these people. I missed work because we didn't know what to expect or what they would do next...
We moved out on the 28th of January and into our new home, while we were moving John showed up to take the washer, dryer and fridge. Desperation is when you go as far as to remove ceiling fans which John took.
After moving out of the home we heard nothing else from Gina and John until almost a month later. Then we learned they had filed a false police report stating that we stole their swing set, the privacy fence which I guess is supposodly at our new home, a gas grill, gold fish and tank, a wreath, mini blinds and a lawn mower which I had asked John the day we were moving what he wanted us to do with it and he stated throw it away and I did just that.
WE had spent two thousand dollars for a new riding mower so why would I need their 100.00 push mower that wouldn't run half the time... I bought new wood blinds from Home Depot for our new home so why would I take her cheap plastic blinds? The swing set was dry rotted so I threw it away after moving into their home in May of the gas grill was junk and would take like 2 hours to cook chicken so for fathers day last year I bought my husband a new stainless steel gas grill. I have an E-mail from Gina stating that I could have the tank because she didn't think they would make the move to Florida. The fence was destroyed last summer in a storm and we threw away what was busted and stacked what was left out back, what happened to it after we moved I could care less... Ans I know for a fact that the wreath was hanging on the door when we moved out.
This is clearly Theft by Deception and harrasment, they have our money and I want it back every penny of it, including our attorneys fees...

HOW TO DETECT A DUMB CRIMINAL

Just look on my space.
I had my nice 5 year old home rented out with the lease option to buy it.
The people quit paying rent, destroyed the inside and outside of the house.
After i had them kicked out of my house they broke back into the house and stole everything that wasn't screwed in the walls.
But to top the icing, they stole my $4000.00 privacy fence and got caught by my friend who is an attorney.
If that is not dumb enough they carried it to their house which is 2 houses down and leaned it against their house for everybody including the sherrif and the prosecuting attorney to see.
Now they get not only locked up, lose their jobs and face felony records but also have a lien on their house for the total damage they done to our house in the amount of $15.000.
And guess what the bitch is a phsycho who is on myspace everyday

These people Gina and John were licensed by the stated of Indiana as professional's a real Estate agent and mortgage broker. This is Harassment and Fraud. I want their License revolked and I want our money back... What shoud our next step be... Enough is enough! I can prove my statement because it's public record at the Clark Count Court house in Jeffersonville Indiana... They can not!!
