The incident happened July 30,1997. We had bought a house from John Trien in El Paso TX. After a year, my husband was transferred from his job to California. John Trien said he would buy it back from us so our credit won't harm us. So we thought he had sold it and it cleared our credit off. But then we found out he sold it to a Jose M. John Trien left the mortgage in our name. Every time Mr. M. Is in default it affects us in our credit. Every time we go to John Trien to let him know it is in default, he keeps telling us he will fix it and keeps stalling.
Mr M. Has passed on his wife was not on the contract but is currently living in the home and it's always at default. We went to let John know that once again it became default under foreclosure. John said he would fix it again. Then he said he had another property that he would let us take over for 950 a month and not to worry about the down payment, that he owed us. Again he said he would pay off the first home. To date, nothing has been done. We took the offer. He said he would pay the mortgage right away so we can buy the second house.
Later, we starting receiving letters at the current house stating foreclosure and auction at our current address a s well as the first. That's when we beagn to think he was doing the same thing to us with another person's name on the mortgage. As soon as we started giving him a hard time, he sent us a letter for us to be evicted. We received the letter Jan 19.
We were watching the news one day on KFOX and listened to others complaints about the same situation about foreclosure and auctions from John Trien Realty. We tried taking this to an attorney but it's too expensive for us. We need help from a real estate attorney. We do not want others to fall into the same situation. Can anyone lead us the right direction or know anyone who can help us in any way? Thank you.
