I was attempting to sell my time share. I had listed my property with one company without success.in July, I received an e-mail inquiry from a company using the name Time Share Solutions in Nevada offering to agressively list my property and the fee was $99.00. I accepted this offer and receive an agreement signed by one Michael Hunt.
On or around August 28, I received a phone call from the same company. This time the person calling identified himself as the General Manager, Bill Ellis. Mr. Ellis had all of the information about my property and stated, "we have sold your property to CIBA-Giegy Corp and they are going to pay you $24,640.00. Since this amount is more than you were expecting for your property, you will have to pay 1/2 of the closing cost which will be $800.00. I need a credit card number so we can proceed with the transaction. I will fax you a copy of the agreement tomorrow and as soon as I receive your reply, I will proceed with the closing of the deal. It will take approximately 30 days top close and you will have your check in hand."
Of course I was excited and anxious to close the deal. On August 29, i received a fax from Bill Ellis outlining the discussion we had the previous day. Now as I look back over the fax I see some discrepancies in the wording of the agreement. It is different from the conversation that I had with Bill Ellis.
Ellis insisted that the deal was "done" and that I would be receiving a check within 30 days. Well, the 30 days passed and no word. 60 days passed and no word. Of course, I was attempting to contact Ellis without success. He was always on the "other" line or was out of the office or there was no answer and the machine answered. Finally, after numerous attempts, Ellis returned my call and "assurred" me that everything was on track and that the only things that was holding up closing was the enormity of the deal that CIBA-Geigy was putting together.
Shortly before Christmas I went through the dog-n-pony show again trying to contact Bill Ellis. I received a call from him in late December assuring me again that the deal was done and that closing would happen perior to January 15.in fact, he guaranteed me that it was done.
Of course I haven't heard from Bill Ellis and they have npot responded to any of my e-mails or phone messages. This is a con, this is a scam, and most likely it meets the definition of "theft by decepttion."
I am angry and I am ready to do battle with Bill Ellis or who ever.
