Court cases and the 2024 data incident
Food Lion, LLC v. Dairy Farmers of America, Inc., U.S. District Court, Middle District of North Carolina, No. 1:20-cv-00442. CourtListener's docket record lists the complaint as filed 2020-05-19 by Food Lion, LLC (and other plaintiffs named in the caption) under 'Antitrust Litigation', with the case terminated on 2021-04-02. This is a business-to-business suit brought by Food Lion as plaintiff, not a consumer case; we did not review how it ended.
Orange soda class action (allegation). Supermarket News reported on October 30, 2024 that Shavonne Daniels sued Ahold Delhaize USA and Food Lion in the U.S. District Court for the Middle District of North Carolina over Food Lion's Omazing Orange Soda, which the suit says contains brominated vegetable oil. The suit alleges, among other claims, unjust enrichment, negligence, failure to warn and fraudulent concealment, and the article reports the product label discloses the ingredient. A company spokesperson said Ahold Delhaize USA does not comment on pending litigation. We could not locate the docket and do not know the case's current status.
Data incident. A sample notice letter dated June 26, 2025, posted on the Delaware Attorney General's site, says Ahold Delhaize USA Services, LLC provides support services to companies including Food Lion, detected unauthorized access to internal U.S. business systems on November 6, 2024, and that an unauthorized third party obtained files from an internal repository between November 5 and 6, 2024. The letter says the files may have held employment records with items such as names, contact details, dates of birth, government ID numbers, financial account details and health information, varying by person, and that the company arranged two years of Experian IdentityWorks credit monitoring and identity protection. The enrollment deadline stated in the letter and on the company's reference guide was September 30, 2025 ("Your code will not work after this date"), so that offer has closed. The letter does not say how many Food Lion employees were affected. This is a regulator-hosted company notice, not a finding by any agency.
Ahold Delhaize USA's notice page (adusaservices.com, read 2026-10-16) says: "Affected individuals include certain current and former employees, their dependents and beneficiaries and others whose personal information was identified in the relevant internal business files"; it also says: "We have no indication that customer payment or pharmacy systems were compromised in connection with the issue." For questions it lists 1-833-931-3792, Monday through Friday, 9 a.m. to 9 p.m. Eastern time, and asks callers to reference engagement number B146471.
Henderson v. Ahold Delhaize USA Services, LLC (M.D.N.C., No. 1:25-cv-00531). The CourtListener docket lists a class action complaint filed June 27, 2025 against Ahold Delhaize USA Services, LLC, Food Lion, LLC and Giant Food, LLC, with later cases consolidated under that number by an order of October 23, 2025. The docket entries do not state the claims, and this page does not characterize them. Named plaintiff Joshua Henderson filed a notice of voluntary dismissal on February 5, 2026 and plaintiff Jon Ankus on February 11, 2026; another notice of voluntary dismissal was docketed April 11, 2026. An amended complaint was filed March 4, 2026, a motion to dismiss and brief on May 4, 2026, and an order on a motion for leave was entered October 13, 2026.
