Cinch Home Services claims, cancelling, refunds and complaints: what Cinch's own pages and agreement say (checked October 7, 2026)

This section collects the routes Cinch publishes. It describes the company's own wording and its sample agreement; your signed agreement and your state's amendments control.

Request service or check a claim. Cinch's Contact Us page says to log in to My Account (my.cinchhomeservices.com and repair.cinchhomeservices.com/account, both linked on the page) to request service or check claim status, and gives (844) 324-5688 for service requests. The FAQ says the deductible is due when you request service and is charged per service trade, so a plumber and an electrician visit each carry a deductible. It also says there is a 30-day waiting period from purchase before service can be requested, and that non-covered charges can apply, for example a permit, a new concrete slab for a replacement A/C unit, or amounts above plan caps.

What the plan pays. On the plans page, as displayed on October 7, 2026 for a South Carolina visitor, Repair Only shows up to $1,000 per covered repair and Repair + Replace shows up to $2,000 per covered appliance, with a $10,000 total limit per agreement term on all three plans (Repair Only, Repair + Replace, Repair + Replace Premier). Prices and limits vary by state and plan. The sample Repair + Replace agreement says the decision to replace rather than repair an item is solely Cinch's option, that it covers an unknown pre-existing mechanical failure only if the failure could not have been detected by visual inspection or a simple mechanical test, and that Cinch may require documentation during a claim review.

Cancel or get a refund. The FAQ and sample agreement say you may cancel by phone or in writing within 30 days of the coverage effective date for a full refund of contract fees paid if no claim has been made. The sample agreement adds that, if a claim was made or after 30 days, you may be entitled to a pro-rata refund of unearned fees less a $25 processing fee plus the cost of any services performed, where permitted by law, and that if a claim was made Cinch may bill you the lesser of the net amount due or the unpaid annual term fee. To cancel at other times the FAQ gives (800) 474-4047 or My Account. State-specific pages in the sample agreement change some of these terms, so read the page for your state.

Renewal. The sample agreement says that where state law permits, the agreement may automatically renew at the issuing company's option for successive twelve-month terms, with notice of rate or coverage changes not less than 30 days before expiry.

Workmanship guarantee. Cinch's 180-day Workmanship Guarantee page says that if the same covered repair or replacement fails within 180 days a service provider will be sent back, and you do not pay another deductible for the same covered repair.

Sears plans. Cinch's Contact Us page tells customers to verify whether they hold a Sears Home Warranty or a Sears Protect Home Warranty: a Sears Home Warranty holder can use Cinch's My Account to submit and manage claims, while a Sears Protect Home Warranty holder is told to call (800) 4MY-HOME to speak directly with Sears.

If you disagree with Cinch. Ask for the claim decision and the plan clause relied on in writing, quoting your plan or contract number. The sample agreement requires disputes to be resolved individually and, with limited exceptions, by binding arbitration, with a class action and jury waiver; small claims court is carved out; and you may opt out of arbitration within 30 days of the agreement date by email to [email protected] or by letter to Cinch Home Services, Inc., Attn: Legal Department - Arbitration Opt-Out, 4700 Exchange Court, Suite 300, Boca Raton, FL 33431. Cinch told the New York Public Service Commission that twenty-eight states require a licence for home service contract providers and that in most of them the state department of insurance oversees it, so your state insurance department is a place to check; you can also contact your state attorney general, the FTC (reportfraud.ftc.gov) and BBB. A Georgia page in the sample agreement describes a surety bond route for unpaid valid claims or refunds after 60 days.

Cinch Home Services regulators: licensing statements and what was checked on October 6 and 7, 2026

Licensing. In comments filed in New York Public Service Commission Case 24-M-0324, Cinch Home Services, Inc. and HomeSure of America, Inc. said that twenty-eight states, including New York, require home service contract providers to hold a licence, that Cinch, HomeSure and its other affiliates hold licences in all such states where required, and that in most of those states the state department of insurance oversees licensure. That is the companies' own statement; this site did not verify each state licence beyond the Florida and California records above.

Florida. The Florida Department of Financial Services licensee search (opened October 7, 2026) lists Cinch Home Services, Inc., license W138123, Boca Raton, with valid HOME WARRANTY (issued 4/16/2013) and SERVICE WARRANTY (issued 11/4/2013) licenses and no invalid licenses. Active appointments listed include HomeSure of America, Inc. and Lyndon Southern Insurance Company (home warranty) and Technology Insurance Company, Inc., Lyndon Southern Insurance Company and HomeSure of America, Inc. (service warranty).

California. The California Department of Insurance company profile (opened October 7, 2026) lists "California Cinch Home Services, Inc." at 4700 Exchange Court, Boca Raton, company type HOME PROTECTION, authorized in California on 03/03/1982, license status "UNLIMITED-NORMAL", with former names Beacon Home Warranty Company (08/27/1986), HAA Home Protection of California (02/26/1999) and HomeSure Protection of California, Inc. (10/25/2023). The Department says that if a home protection company denies your appeal you may seek assistance from the Department at 1-800-927-4357 or by filing an online Request for Assistance.

New York PSC proceeding. Case 24-M-0324 is a Commission proceeding on energy services company (ESCO) home warranty product offerings. In its comments Cinch responded to a Department of Public Service staff white paper that mentioned lawsuits against other home warranty companies (Amazon Home Warranty, LLC and CHW Group Inc., d/b/a Choice Home Warranty) in Ohio and Arizona, and said staff unfairly conflated those descriptions with Cinch's programs. The document is a set of comments in a regulatory proceeding, not an enforcement action against Cinch.

What was and was not found. In web searches run on October 6, 2026 for Cinch Home Services together with attorney general, consent order, department of insurance, FTC and settlement, and in the BBB profile and docket sources listed on this page, no consent order, civil penalty or enforcement complaint naming Cinch Home Services, Inc. or HomeSure of America, Inc. was identified. That is a statement about the sources checked, not a finding that none exists: individual state insurance-department and attorney-general databases were not each searched.

Cinch Home Services background: Boca Raton home warranty provider, Cross Country Home Services rebrand and Sears plans

Cinch Home Services, Inc. is a Boca Raton, Florida company at 4700 Exchange Ct, Suite 300, that sells and administers home warranty plans, which its sample agreement calls Home Service Agreements ("not an insurance policy"). The company says it has served homeowners since 1978; BBB's page data lists incorporation on October 27, 1978, business start on October 9, 1979 and a BBB file opened December 20, 1983 (BBB's rendered page shows these a day earlier).

History and names. A trade report dated October 16, 2019 says Cross Country Home Services (CCHS) announced a companywide rebranding to Cinch Home Services Inc. and that subsidiaries including HMS Home Warranty and TotalProtect would consolidate under the Cinch name. BBB lists alternate names including HMS National, Inc., Homesure of America, Inc., TotalProtect, Real Estate One Home Warranty and others. BBB's page for Cinch Home Services, Inc. also shows separate BBB location listings named "Cross Country Home Services" (Barrington, Illinois) and "HMS Home Warranty" (Houston, Texas); each listing, when opened on October 11, 2026, carries the Cinch Home Services, Inc. Boca Raton listing as its headquarters. This site treats these as names that Cinch's own announcement and BBB's file connect to Cinch; it did not verify them in a state corporate registry. Cinch's New York filing is headed "A Cross Country Group Company" and says Cinch Holdings, Inc. (formerly Cross Country Home Holdings, Inc.) is the parent of HomeSure of America, Inc. and of Cinch Home Services, Inc.

Who issues the plan. The sample agreement says plans are issued by HomeSure Services, Inc., except that in AL, AZ, FL, IL, IA, MA, NV, NH, NM, NY, NC, OK, SC, TX, UT, VT, WA, WI and WY the issuer is HomeSure of America, Inc.; in California it is California Cinch Home Services Inc.; and in Virginia and Oregon it is HomeSure of Virginia, Inc. Claims administration is by Cinch Home Services, Inc., and repairs are done by independent service professionals. Cinch says its providers are screened for licensing and active liability insurance. Company figures on its own pages include "8 million+ homeowners" since 1978 and "$1 billion in claims paid over the last seven years"; these are company statements.

Plans. Cinch lists Repair Only, Repair + Replace and Repair + Replace Premier plans for appliances and systems such as heating and air conditioning, electrical and plumbing, and kitchen and laundry appliances; Premier adds outside water, sewer and gas lines and extra coverage for items such as permits and disposal. Each plan has exclusions, caps and per-item limits described in the sample terms.

Sears. Cinch's Contact Us page treats Sears Home Warranty holders as customers who can use Cinch's My Account to submit and manage claims, and sends Sears Protect Home Warranty holders to Sears. The page does not describe the commercial arrangement beyond that.

Cinch Home Services complaint record: this site's archive, BBB, Trustpilot and ComplaintsBoard (as displayed October 7, 2026)

This site's archive. A search of this site's approved posts for "Cinch Home Services" found no approved post under that exact name. The archive does hold approved posts dated 2003 to 2012 filed under earlier names (77 posts matched a name search on October 7, 2026). After the names were checked on October 11, 2026 against the 2019 trade report and BBB's listings described above, 67 of them are linked to this profile: 20 whose offender name is "Cross Country Home Services" (the name the trade report says was rebranded to Cinch) are shown as this profile's own posts, and 47 filed under HMS Home Warranty, HMS National, HomeSure, TotalProtect and Systems Protect names (named in the trade report as subsidiaries consolidating under Cinch, or listed by BBB as alternate names) are linked as affiliated names and are not counted as own posts. Posts filed under the names "Cross Country Home Warranty" and "Home Protect" were not linked, because none of the sources opened ties those names to Cinch. These posts are consumers' accounts written under the earlier names, years before the 2019 rebrand; they have not been verified by this site and are not combined with the BBB, Trustpilot or ComplaintsBoard figures.

BBB. The BBB profile for Cinch Home Services, Inc. (Boca Raton, headquarters) shows rating A+, BBB Accredited, "2,392 total complaints in the last 3 years" and "726 complaints closed in the last 12 months", and a customer review score of 1.05 out of 5 with "Average of 739 Customer Reviews", as displayed on October 7, 2026. BBB's page raw data gives accreditation on June 27, 2019. BBB notes that complaint counts should be read with the size of the business and that it does not verify the accuracy of information from third parties.

Trustpilot. Trustpilot shows 5,281 reviews and a score of 4.1 for cinchhomeservices.com on October 7, 2026, a claimed profile dated August 2019 and a paid Trustpilot subscription. Trustpilot says it does not fact-check reviews and shows an AI-generated summary of recent reviews.

ComplaintsBoard. ComplaintsBoard displays a 1.4 rating from 19 reviews and 32 complaints (page updated September 24, 2026). These are user-submitted posts.

The BBB, Trustpilot and ComplaintsBoard figures differ, measure different things (BBB complaints and reviews, Trustpilot reviews, ComplaintsBoard posts) and are not averaged or combined. Statements in customer posts on those sites are the customers' accounts. Cinch's pages describe a seven-time ConsumerAffairs award record and "1 million+ claims serviced over the last three years"; these are company statements and were not independently verified.

Cinch Home Services litigation record: Darling v. Cinch Home Services (S.D. Fla.) and Cunningham v. Cinch (C.D. Cal.), TCPA

Darling v. Cinch Home Services, Inc., No. 9:25-cv-81566 (S.D. Fla., Judge Aileen M. Cannon). The docket lists the case as filed on December 15, 2025 by Todd Darling, with nature of suit "Telephone Consumer Protection Act (TCPA)" and a jury demand. Cinch was served on January 8, 2026 and on March 2, 2026 moved to compel arbitration, to dismiss the complaint for failure to state a claim and to strike the jury demand. On April 3, 2026 the court entered an order described on the docket as "GRANTING DEFENDANT'S MOTION TO COMPEL ARBITRATION BY DEFAULT AND STAYING CASE", stating that the case is stayed pending resolution of any arbitration proceedings and closed for administrative purposes only. The docket was last retrieved by Justia on April 3, 2026. This page did not review the complaint's allegations, and the case has not been decided on the merits.

Cunningham v. Cinch Home Services, Inc., No. 2:20-cv-08875 (C.D. Cal.). CourtListener lists the case as filed on September 28, 2020 (cause: Telephone Consumer Protection Act, jury demand by the plaintiff). On February 5, 2021 the court entered an in-chambers order dismissing the case without prejudice "in light of the parties' Notice of Settlement", and on March 1, 2021 Cinch filed a stipulation to dismiss. The settlement terms are not on the docket entries read.

Related docket. CourtListener also lists a separate docket, No. 9:25-cv-81565 (S.D. Fla.), titled Darling v. Cinch Home Services, Inc., filed on December 15, 2025, whose only entry read is a Clerk's Notice of Docket Correction dated December 16, 2025. The Darling docket on Justia was last retrieved on April 3, 2026 and PACER may hold later entries.

Arbitration and class waiver provisions appear in Cinch's sample agreement, and its website Terms of Use provide for arbitration administered by Arbitration Resolution Services, Inc. and Florida law for website disputes. This is not an exhaustive search of Cinch litigation: a CourtListener case-name search for "Cinch Home Services" on October 7, 2026 returned three federal dockets, described here, and state-court and arbitration matters were not searched.

Is Cinch Home Services Legitimate?

Cinch Home Services, Inc. is an operating company with a published Boca Raton address, a BBB file opened December 20, 1983 per BBB's page data, BBB Accredited status since June 27, 2019 and an A+ BBB rating as displayed on October 7, 2026, and a sample agreement that names the issuing entity for each state and describes a Georgia surety bond route for unpaid claims or refunds. In its New York filing the company says it holds home service contract licences in every state that requires one; this site did not verify each licence.

The same sources also show a large volume of consumer disagreement: BBB displays 2,392 complaints in three years and a 1.05 out of 5 customer review score, while Trustpilot displays 4.1 from 5,281 reviews. A TCPA lawsuit against the company was stayed for arbitration in April 2026. Home warranty plans are contracts with caps, exclusions and a required claim procedure, so what is covered turns on your plan and state page. Read the exact terms of your contract and keep records of every service request and deductible payment.

Frequently Asked Questions

How do I request service or file a claim with Cinch Home Services?

Cinch's Contact Us page says to log in to My Account to request service or check claim status, with (844) 324-5688 for service requests. The FAQ says the deductible is due when service is requested and is charged per service trade, and that a 30-day waiting period applies from purchase before service can be requested. Keep your plan (contract) number ready; it is also used to open an account.

Where is Cinch Home Services licensed and how do I contact a state regulator?

The Florida Department of Financial Services lists Cinch Home Services, Inc. under license W138123 with valid HOME WARRANTY and SERVICE WARRANTY licenses as of October 7, 2026, and the California Department of Insurance lists California Cinch Home Services, Inc. with license status UNLIMITED-NORMAL. Cinch told the New York Public Service Commission it holds licenses in every state that requires one; other states were not checked on this page. California consumers whose appeal is denied can call 1-800-927-4357 or file an online Request for Assistance; elsewhere, start with your state insurance department or attorney general.

How do I cancel a Cinch Home Services plan and what refund applies?

The FAQ says to call (800) 474-4047 or use My Account. The sample agreement allows cancellation by phone or in writing within 30 days of the coverage effective date for a full refund of contract fees if no claim has been made. It also describes a pro-rata refund of unearned fees less a $25 processing fee and the cost of services performed, and says that if a claim was made Cinch may bill the lesser of the net amount due or the unpaid annual term fee, where permitted by law. State-specific pages change some terms.

Is Cinch Home Services the same company as Sears Home Warranty?

Cinch's Contact Us page says Sears Home Warranty holders can use Cinch's My Account to submit and manage claims, and that Sears Protect Home Warranty holders should call (800) 4MY-HOME to speak with Sears. Cinch Home Services, Inc. is the Boca Raton company named in its Terms of Use; the page does not describe the commercial arrangement with Sears beyond that instruction.

Who owns Cinch Home Services and what was it called before?

Cinch's filing in New York PSC Case 24-M-0324 says Cinch Holdings, Inc. (formerly Cross Country Home Holdings, Inc.) is the parent of HomeSure of America, Inc. and of Cinch Home Services, Inc. A trade report dated October 16, 2019 says Cross Country Home Services rebranded to Cinch Home Services Inc., consolidating brands including HMS Home Warranty and TotalProtect. Who owns Cinch Holdings, Inc. was not established from the sources checked on October 7, 2026.

What does Cinch's 180-day Workmanship Guarantee cover?

Cinch's guarantee page says that for a covered repair or replacement the provider's workmanship is guaranteed for 180 days after completion; if the same covered repair or replacement has an issue within that time, Cinch will send a service provider back subject to plan terms, with no new deductible for the same covered repair. A different problem needs a new service request and a new deductible.

Can I sue Cinch Home Services or join a class action?

The sample agreement requires disputes to be handled individually and, with limited exceptions, by binding arbitration, with a class action and jury waiver and small-claims court carved out. It lets the customer opt out of the arbitration clause within 30 days of the agreement date by email to [email protected] or by letter to Cinch's Legal Department in Boca Raton. A TCPA case, Darling v. Cinch Home Services (S.D. Fla.), was stayed in April 2026 pending arbitration; an earlier TCPA case, Cunningham v. Cinch Home Services (C.D. Cal.), was dismissed without prejudice in February 2021 after a notice of settlement. Ask a licensed attorney about your own contract.

Where can I complain about Cinch Home Services besides Cinch?

Cinch told the New York Public Service Commission that most states that require home service contract licences use the state department of insurance for licensure, so your state insurance department is one route; your state attorney general, the FTC (reportfraud.ftc.gov) and BBB are others. In California, the Department of Insurance says consumers whose appeal is denied by a home protection company may call 1-800-927-4357 or file an online Request for Assistance. BBB shows 2,392 complaints in the last 3 years for Cinch's Boca Raton profile as displayed on October 7, 2026.

What do outside reviews of Cinch Home Services show?

As displayed on October 7, 2026, BBB shows an A+ rating with a 1.05 out of 5 customer review score from 739 reviews, Trustpilot shows 4.1 from 5,281 reviews on a profile with a paid subscription, and ComplaintsBoard shows 1.4 from 19 reviews and 32 complaints. The sources measure different things and are not combined. Older posts on this site filed under Cinch's former names (2003 to 2012) are described in the complaint record section and are not combined with these figures.
