Allstate claim, billing, cancellation and roadside problems: where to go first

Start a claim. Allstate says most claims, including auto, home, condo, renters and motorcycle, can be handled in My Account, and "Not an Allstate customer? Call 800-255-7828 to file your claim." Flood claims are filed with an online loss report, phone protection claims go through Squaretrade, and identity theft or fraud claims go to 855-821-2331.

Track it and push it. Allstate's claims FAQ says you can check status in the Allstate mobile app, My Account or with your agent, and that a new claim should show in MyClaim within 24 to 48 hours; if it does not, it tells you to call 1-800-255-7828 or message your claims contact in MyClaim. On timing it says "Covered claims may be eligible for settlement within 48-hours of adjuster assignment, although timeframes may vary based on the loss' circumstances."

If you disagree with an estimate. Allstate's answer is: "Contact your claim representative with any concerns, and they'll work with you to find a fair solution." Put the disagreement in writing (a message to your claims contact in MyClaim keeps a dated record), attach your own repair quote or photos, and ask for the basis of the figure (for a total loss, the valuation report; for property, the depreciation shown). Allstate's FAQ says you are free to choose any repair shop. If you are served with a lawsuit connected to a claim, Allstate asks you to send the paperwork immediately through My Account or the app, or through your claim contact or 1-800-ALLSTATE (255-7828).

If the other driver is insured by Allstate. You are a third-party claimant: you deal with the adjuster handling the other driver's liability claim, not with a policy of your own. Many reports on this site come from this situation (fault disputes, low vehicle valuations, slow payment). Ask for the claim number and adjuster's name in writing, and use your own collision coverage if you have it.

Billing. Allstate's billing FAQ says a missed or late payment "can result in a lapse in coverage, or the cancellation or termination of your policy" and tells you to contact your agent or call 1-866-998-8388. To stop automatic charges, it says to terminate enrollment through Payment Center in My Account or the app, or contact your Allstate agency. A one-time credit or debit card payment unenrolls you from the Easy Pay Plan and removes its discount for the rest of the policy period (not in California, which has no Easy Pay discount).

Cancelling a policy. Allstate's policy FAQ answers the cancellation question with "Please contact Allstate for assistance." Call customer service at 1-800-726-6033 (the number on Allstate's contact page) or your Allstate agent, give the date you want coverage to end, and ask for written confirmation of that date and of any refund. Cancellation and refund terms vary by state and by policy, so read the cancellation section of your own policy contract: My Account holds your full policy package, and Allstate posts its policy contracts by state, listed by the form number shown first under "Your Policy Documents" in your welcome package. As one example, Allstate's Alaska auto policy form AU12883 says you may cancel by writing to tell Allstate the future date coverage should stop, and that any refund due is prorated and returned or credited within 45 days of the request or the cancellation date, whichever is later; other states' forms can differ. Start the new policy before the old one ends, keep proof of your request, and do not treat stopped payments as a cancellation, since a missed payment can cause a lapse.

Roadside. Allstate lists 800-347-8880 for roadside requests and says roadside from a membership plan is "not considered an insurance claim," while auto-policy roadside coverage requires a claim for towing and related services. Before arguing about a refused tow, check your plan's limits: Roadside Assist and Roadside Advantage include three service calls a year, with 15 and 25 miles of towing, and Roadside Elite includes five calls and 100 miles. If membership charges continue after you cancel, ask Allstate in writing to stop and refund them; a credit card charge can also be disputed in writing with your card issuer within 60 days after the statement showing it was sent.

Complain to the state regulator. The National Association of Insurance Commissioners says: "Having a problem with an insurance company or agent? Find your state insurance department and file a complaint." Do this after you have given Allstate a written chance to respond, file with the department of the state where your policy was issued or where the loss happened, and include the policy or claim number, the adjuster's name, dates and copies of letters. The state insurance department is the regulator for claim handling, cancellations and rates; your state attorney general's consumer protection office also takes complaints about business practices, and the FTC accepts reports at ReportFraud.ftc.gov.

The linked reports are mostly from policyholders and from people injured or damaged by an Allstate-insured driver. They describe disputed fault and low claim valuations, delays in homeowner and renters claims, premium increases and rate changes, cancellations or non-renewals after a claim, and slow or missed roadside and Motor Club service. They are consumers' accounts, not findings by a regulator or court. Nearly all were posted between 2002 and 2013.

State regulator and attorney general matters

Texas data-privacy suit. On January 13, 2025 the Texas Attorney General sued Allstate and its subsidiary Arity in Montgomery County, Texas. The press release says Arity paid app developers to include tracking software, that Allstate "collected trillions of miles worth of location data from over 45 million consumers nationwide," and that the conduct violated the Texas Data Privacy and Security Act, which requires clear notice and informed consent for sensitive data such as precise geolocation. The office described it as the first enforcement action by a state attorney general under a comprehensive data privacy law. The petition also cites the Data Broker Law and the Texas Insurance Code. Allstate has said it "has fully complied with all state laws and regulations." On April 10, 2025 the trial judge ruled that the court has no jurisdiction over two of the defendants, The Allstate Corporation and Arity 875, LLC, Bloomberg Law reported; that ruling did not decide whether the allegations are true and does not cover the other defendants. The State of Texas appealed that ruling as to Arity 875, LLC to the Fifteenth Court of Appeals (State of Texas v. Arity 875, LLC, No. 15-25-00213-CV); the appeal was submitted to the court on May 21, 2026, and the docket shows no decision.

Where state insurance regulators fit. Insurance companies are licensed and supervised by each state's insurance department, which takes consumer complaints about claim handling, cancellations and rates. Complain to the department of the state where your policy was issued or where the loss happened, not automatically to Illinois, where Allstate is based; the NAIC directory links to each one.

Court record: Texas v. Allstate and Arity

The Texas Attorney General's petition names The Allstate Corporation, Allstate Insurance Company, Allstate Vehicle and Property Insurance Company, Arity, LLC, Arity 875, LLC and Arity Services, LLC as defendants in the 457th District Court of Montgomery County, Texas. It alleges violations of the Texas Data Privacy and Security Act, the Data Broker Law and the Texas Insurance Code. On April 10, 2025 Judge Vince Santini ruled in a one-page order that two defendants cannot be sued in Texas, Bloomberg Law reported: The Allstate Corporation, which is not headquartered or incorporated in the state, and Arity 875, LLC, which lacks a meaningful presence there. That ruling concerned only the court's jurisdiction over those two companies; it did not decide whether the data-collection allegations are true, and it does not address Allstate Insurance Company or the other defendants. See the regulator section for what the suit alleged and Allstate's response.

457th District Court, Montgomery County, TexasDocket 25-01-00561Source ↗

Filed — no final outcome recorded

Civil suit by the Texas Attorney General under the Texas Data Privacy and Security Act, the Data Broker Law and the Texas Insurance Code, alleging that Arity software embedded in third-party mobile apps collected driving and location data that was used and sold without notice or consent. On April 10, 2025 Judge Vince Santini signed a one-page order holding that two of the six defendants cannot be sued in Texas: The Allstate Corporation, because it is not headquartered or incorporated in the state, and Arity 875, LLC, because it lacks a meaningful presence there, Bloomberg Law reported. That order decided only the court's jurisdiction over those two companies, not whether the allegations are true. It does not cover Allstate Insurance Company or the other defendants.

Who Allstate is and how its brands fit together

The Allstate Corporation, a Delaware holding company incorporated on November 5, 1992 and headquartered at 3100 Sanders Road, Northbrook, Illinois, says in its 2025 Form 10-K that it was formed to serve as the holding company for Allstate Insurance Company. The filing says the group uses the Allstate, National General and Answer Financial brands extensively. Allstate acquired Esurance in 2011 and, according to its 2020 Form 10-K, decided in the fourth quarter of 2019 to integrate Esurance into the Allstate brand. Allstate's website footer lists Allstate Identity Protection, Answer Financial, Arity, Encompass, National General and Allstate Health Solutions as affiliates, and separate login links for Motor Club and Roadside.

The profile covers Allstate-branded insurance (auto, home, renters, condo, motorcycle, roadside and related products). Encompass and National General are separate brands; for those policies, use the contact details on your own policy documents. Allstate's billing FAQ also lists separate phone numbers for life insurance and annuity products, including Allstate Life of NY at 1-800-262-1028 and policies handled by Everlake at 1-844-953-0347.

The other driver is insured by Allstate. Who handles my claim?

Allstate's claim representative for the other driver handles your third-party claim. Ask for the claim number and adjuster in writing. Your own insurer's collision coverage is another route, and the time limit for suing differs by state.

How do I cancel an Allstate policy?

Allstate's policy FAQ says to contact Allstate to cancel: call customer service at 1-800-726-6033 or your Allstate agent, give the date coverage should end, and ask for written confirmation of that date and of any refund. Cancellation and refund terms vary by state and by policy, so read the cancellation section of your own policy contract; it is in your policy package in My Account, and Allstate also posts its policy contracts by state. Do not simply stop paying: Allstate's billing FAQ says a missed payment can lead to a lapse or cancellation.

What happens if I miss an Allstate payment?

How do I stop Allstate automatic payments?

Allstate says to terminate enrollment through Payment Center on My Account or the Allstate mobile app, or to contact your Allstate agency.

Does Allstate roadside assistance count as an insurance claim?

Allstate says roadside from a membership plan is not an insurance claim and will not affect the auto premium, while auto-policy roadside plans require a claim for towing and related services. Request service at 800-347-8880.

How do I file a complaint about Allstate with my state?

First give Allstate a written chance to fix the problem and keep the claim or policy number. If that fails, file with the insurance department of the state where your policy was issued or where the loss happened; the NAIC directory links to every state department. Include the policy or claim number, the adjuster's name, dates and copies of your correspondence with Allstate.
