Americredit
Wrongfull repo

I bought a car financed through AmeriCredit in 2007.
For two years, was never late on a payment.
In my payroll checks started bouncing... And several of the payments I made to AmeriCredit were returned by the bank.

I went into business for myself and proceeded to make arrangements with AmeriCredit to get caught up. I was offered a deferment for two months (Oct/ Nov) to help bring my account current. I paid the amount required for the deferment.

In Jan I paid over and above my normal payment and in February I paid the regular monthly payment.in March, they repossessed my car stating that they had not received a full payment since December and that I was 74 days past due.
I borrowed the money to get my car out of jail, however was informed by AmeriCredit's "re-instatement department" that from now on I would have to check in with them once a week... Like an ex-con on parole.

After I reviewed my bank statements, I found that AmeriCredit never applied my February payment to my account, although when I called in Feb to confirm they had received the payment, I was told they had.

I called my Bank and we had a conference call with customer service at AmeriCredit.
My bank not only verified the payment was made and cleared my account, they said AmeriCredit had already cashed the check.

I requested that the payment be researched to find out where it was. AmeriCredit then told me and my banker that their payment research department would only research the payment IF they felt the information I provided was appropriate.
I informed AmeriCredit that I had specific transaction details and reference numbers showing the payment had cleared my account. Americredit then told me that I needed to send my entire statement so that the balance of my account could be seen after the payment went through.
At that point my banker informed AmeriCredit that what she was asking was unacceptable. The bank advised me to send the specific transaction details I had and if AmeriCredit's payment research center refused to research the payment, then they strongly advised me to contact an attorney.

I'm certainly open to joining any class action suits being filed against this company.
