Fraudulent practices and predatory lending fraudulent ripoff business

To whom It May Concern: I would really like to thank the person who told me about usacomplaints.com and also about the ruthless advocate (Great Thorn) who goes after businesses that prey on minority consumers with predatory lending practices.

My name is Michelle Bass. My husband Roy Hall purchased a 2003 S-10 from Bill Heard chevrolet of Union city in October. At the time of the purchase I was visiting family in Arizona. I recieved a call from my husband informing me he needed me to co-sign on the new vehicle.

The car salesman later called me. My husband the car salesman and I had a conference call. I informed the car salesman (Edward Weems) that I could only co-sign with the trade-in included because we could not afford two vehicles. He said he understood and sent the contracts next day mail.

When I arrived in Atlanta the following week phone calls started with the prior financer of the Nissan Altima. They could not understand why they had not yet recieved a payment from my husband considering we had never been late with a payment before. We then called Bill Heard chevrolet to see why our trade-in had not yet been paid off. A man by the name of (Joseph Johnson) told us there was no trade-in and the person who was our salesman no longer worked at there dealership. During this time Bill Heard chevrolet had possesion of our trade-in.

Fortunately we were able to contact the prior salesman and we explained our dilema to him. He then called up to the dealership and explained to (Joseph Johnson) and to a man name (Paul Hewitt) that there must have been a mistake, we did have a trade-in.

Paul Hewitt told us to come to the dealership and re-sign the contracts. He apologized for the inconvience because it was now early December. He also informed us our payments would be pushed back an additional 30 days because of the dealership mistake. Mr. Hewitt told my husband and I to come to the dealership monday December 16th to finalize everything again. This was now the third contract. When we arrived at the dealership monday we were informed that Mr. Hewitt had passed that weekend from a fatal heart attack.

We were very sympathectic and understood since Mr. Hewitt was handling our case that things would now take longer to resolve would now take longer. Mr. Joseph Johnson reassured us that

I was curious why the percentage rate on our contracts for purchasing the truck was 14.20%. I thought it would be lower because of my good credit. I was informed by Mr. Johnson that my credit was not good enough to lower the rate, but after a year it would decline.

In Februrary we were informed that the dealership was not going to pay off our trade-in nor pay any late payment that had now accrued on our new truck since October.

Hearing this we were very upset. We tried on many occasions to contact the General Manager of the dealership (Steve Johnston). We then contacted Bill Heard corporate office and they reffered us back to the Union City dealership. After we contacted the corporate office Mr. Johnson then contacted my husband and I to meet in his office about our concerns. Present during this meeting was Mr. Steve Johnston (General Manager), Kelly Burnett (public relation of Bill Heard chrevrolet in Union City) and Joseph Johnson (financer for Bill Heard).

Mr Johnston started the meeting by telling us what he believed our dilema was. My husband then told Mr. Johnston that everything he believed had happen with the trade-in was not true. My husband and I began to take turns telling him what really happen.

The entire meeting was strickly poignant. Mr Johnston did not believe us or did not care. We were sitting there with all those contracts and proof from the original salesman and no relief from Bill Heard chevrolet. Mr. Johnston did offer to pay our remaining late payments on our new truck, however if Bill Heard dealership had not put us in this predicament there would be no late payments. Four months later our trade-in was steal at Bill Heard chevrolet.

The Georgia office of consumer affairs contacted Mr. Johnston (General Manager). He informed the representative that my husband bought the car without the trade-in and later we both came to the dealership and ask would they take our trade-in because we could not sell it. Mr. Johnston also informed the representative that we had late payments on our new truck because it was around the holiday and we went shopping and spent the money. Those statements Mr. Johnston made to consumer affairs was an absolute lie. We incured late payments on our truck because we were told by Mr. Johnson (the financer) our first payment was to be thirty days after our contract was finaled with our trade-in included.

Mr Johnston (General Manager) got this idea from Mr. Johnson (the financer). Mr. Johnson was the last person working on our contracts and before he will look incompetent to his boss he will blantly lie on us.

Days after our meeting with the parties at the dealership they returned the trade-in that they had in there possession for four months. The prior automobile financer repossessed the vehicle and our credit is now trashed because of Bill Heard chevrolet.

I also noticed the finance rate for the new truck was 14.20% when my husband signed the contract without me. And when I co-signed on the contract it was still 14.20% with my good credit. It seem as though Bill Heard chevrolet never had good intentions when they sold us our new truck.
