Bait and Switch Price Changing ripoff

When speaking to Gary about trading in my Jeep that I purchased from Pepe Motors for the 2003 Hyundai Tiburon GT, I specifically asked him point blank how much money would it cost me for the trade in of the jeep and the purchase of the Tiburon.

I explained I only had a certain budget and I had to know before the deal was agreed upon what cash I would need to go forward on the deal. He told me it would be $1,800 but for me it would be $1,500. I therefore agreed to purchase the Tiburon. I didnt make the purchase then and there because he wanted time to make the repairs he told me he would make. The wheels needed to aligned, he told me he would fix the rubbed off paint around where the gas nozzle goes in when putting gas in the car, the rear view mirror on the drivers side was going to be replaced since the housing was smashed as he showed me the mirror that had arrived to be replaced and he said he was going to fix the vents that were broken where the air-conditioning comes out.

I came in to make the official deal and pay for the car.
Gary was not there but Sylvia was there. I thought that odd since I had been talking exclusively with Gary and Sylvia really knew nothing about the details of the purchase of the car.

Sylvia had a stack of papers which I was to sign. When it came time to go over the details of the deal, I became confused. I couldnt figure out why after I gave her a check for $1,500.00 how according to her paperwork I still owed $1,500.00. I asked Sylvia to please show me the numbers on the computer she was working on. She replied in a round-the-rosy manner that the computer did not show the numbers.

I questioned her and told her I still did not understand the numbers. She asked me if I didnt kike the car. She said something like — all that matters is that I have a nice car I like as I didnt like the jeep anyway. She again told me what a good deal I was getting. I agreed that I did like the car but I still didnt understand the numbers.

She again told me the numbers didnt show on the computer in any of the paper work but they were right. She explained in a very confusing way verbally - the amount of the trade in; how I was given much more credit than I should have been given for the traded in Jeep, she explained the extra amount that was taken off the Tiburon and how anywhere else it would have cost more and how they were doing me a favor for taking the jeep back as a trade in and all things considered I was getting a good deal. I reluctantly signed the papers even though I did not understand it.

I went home and was extremely bothered by the transaction with Sylvia and I tried to work out the numbers at home. Anyway I did it I came up with the same answer. Somehow there was a $1,500.00 discrepancy. I didnt understand how I could still owe $1,500.00 after I paid $1,500.00.

I drove back to Pepe Motors the next day with the Tiburon and two friends to confront Pepe Motors about the discrepancy in the quoted price and the price I got on the paper work from Sylvia.

I spoke again with Gary this time. He got so angry, yelling and ranting and raving and yelling at me and said that he never said it was going to be $1,500.00 that he said it was going to be around $1,500.00. That is not the way it was at all. I had told him I needed to know how much it was going to be before I bought it to know if it would fit in my budget. My budget would not allow me to spend $3,000.00. I would never have agreed to purchase the car if the purchase required that much money. I did not have that much money to put toward a car.

I told Gary that I didnt want the car if it was going to cost $3,000.00 rather than the $1,500.00 he told me. He said he told me around $1,500 because that didnt include taxes, license transfer etc. I do not remember him saying around $1,500.00 and if he did say that as he claimed how could tax and license cost an additional $1,500.00?

I told Gary that I could not afford the car if that were the $3,000.00 price and told him I wanted my Jeep back and I wanted to cancel the deal. Gary refused to give me my Jeep back in return of his Tiburon. He got so angry he face turned beet red and he became violent to the point of cutting his hand on the doorjamb in his office. Then his remark was, See what you made me do?
Pepe Motors has shown me total lack of professionalism, lack of integrity and displayed dishonesty extraordinaire.

Gary was to get back to me on the price as he said he would do something to make it right. I have never heard another word about it. I did receive a phone call several days ago from Sylvia demanding that I pay the additional $1,500.00 as I was now delinquent on that amount.

In addition the car has not been repaired as Gary said it would. I had to personally return the car to where the alignment was done to have the problem fixed that was not fixed on the part of Pepe Motors of extreme pulling to the right. The gas tank cover has not been touched up, the air conditioner vents have not been fixed, and the rear view mirror has not been replaced.
