I purchased a vehicle on Dec. 04. Few weeks later, I was called back into dealership and Brown's Arlington Nissan try to raised the interest rate. I immediately declined to sign a new contract and requested to get my trade-in vehicle back. After negotiations among themselves, the finance manager for the 2nd time apologize for the inconvenience, gave me a full tank of gas and I left the dealership for the 2nd. Time approved.
In January 05, I started receiving phone calls from Brown's Arlington Nissan (Jay from Finance) that they needed additional information regarding my income and a check for the 1st car payment. I advise them that I would not write any additional checks payable to them and that I wanted to contact the bank directly because I was also getting several phone calls from the bank of the vehicle that I traded in, because Brown's did not pay them. They refuse to provide me with that information.
Brown's Arlington Nissan (Jay), the note holder for the vehicle that I traded and myself had several conversations reqarding payment for my trade in. Their answer was that they couldn't pay my trade-in until they get funded. They also told my current note holder that the car was approved and that it shouldn't take longer than a week to fund. I have contacted them to use those recordings when is time to go to court.
When they realize that I was not giving them any additional money, they are now requesting that I return the vehicle. Now, I am stuck with a REPOSSESION in my credit report, without the $1,000 that I gave as a downpayment and having to pay the car payments from December to February including late fees.
I am willing to take this situation to the last consequences because Brown's Arlington Nissan needs to treat people with respect. This is an out-rageous rip-off!!! If there is anyone out there that has been through this type of situation and can help me, please contact me as soon as possible.
