Disregarding payment arrangement

We all make mistakes. Had we known this was a sub-prime lender 5 years ago we would have looked else where. When one is in the dealership and getting the used car at the price that works you don't take time to check finance companies out. You just sign the loan papers and get the keys. Our problems with Americredit were not until February. We had a 60 month loan. I had deferred payments with no problem moving them to the end of the loan. Yes, we did get behind in payments because of a job loss.in January, we received our statement that had this number with "We understand the problems with the economy and we are willing to work with you." We had never seen the number before and we knew we were behind in our loan. So I decided to call the number (bad mistake) and talk to a rep who stated making the one payment for December was great and she would take that, she understood. I assured her I would pay the January payment on February 28th the next time my husband got paid she said that was fine. I mailed the payment or so I thought but Americredit never received the money order (right). March 9th my husband got a call saying he had to pay 3 payments by the end of the month but did not get told if you do not we will repossess the car. March 19th the car was repossessed, that day we tried calling a few times to get how much we owed, how could we get the car back not one person in the company could tell us an amount. I spoke to a Taylor, when I stated that I had sent the money order and did not understand what was going on. He stated.' B&t*h I do not have time to argue with you. You chose to screw us and not pay your D*@n bill.". Again there never was an amount to pay. (California state law says that a finance company representative can not use threats, abusive or profane language but apparently it is not an Americredit law). Then between Thursday and Tuesday we got 5 different amounts to pay, more abuse and rude behavior on their part and no paper work to support any of the numbers they demanded, in spite of asking for paperwork to support their requests. Finally on Tuesday a letter arrived stating that we needed to pay this amount to reinstate the loan. I immediately quick collected the amount to them at 11:00 am. Then called with the confirmation number and ask how to get my car back. They waited until 5 P.M. To call my husband and tell him they were not sure we could get the car back because we still owed almost 500 dollars and it had to be paid by April 15th. The next morning my husband called and got told they would send back the money we paid since we did not pay total pay off amount and we could not get the car back. He stated we paid the amount on the letter they mailed. She told him that a computer made a mistake on the form. (Rule one computers do not make mistakes on their own, people do). Soon after Ariel, the manager came on the line. Ariel told us that they are in control and we should understand that, she finally told us where our car was and we got it back (minus personal items) Now after 5 attempts to get a payment history they finally sent one in April.in reviewing this payment history it shows we overpaid 5 dollars but tacked on to the bottom is a charge for almost 500 dollars but when we call the car is paid off one minute and the next you owe 888 dollars then 400. Still we have not received any paper work of why we owe the company any money or a bill to pay by April 15th. Dealing with Americredit has been a disaster, We have contacted an attorney. Please if Americredit is giving mixed messages or you have made any arrangements that they have not honored, please file a complaint and contact an attorney.
