Bank of america refuses to cash a check. All we wanted was to cash a check drawn at bank of america and give us a cashiers check.
We walked in and they said that they would not cash check for the amount and they don't cash checks for non bank of america customers.
This is a a violation of the law.
If someone writes a check to someone, it is because they owe the payee money. The money represenbted by that instrument is the property of the payee. It is not in "escrow"; the porpery rights to the money represented by that instrument are not dependednt upon the banks' willingness to cash the check, and if the bank refuses to cash the check for any reason or no reason at all (other than insufficiency of funds), the bank is engagin in "unlawful detainer" of the property of the payee — this consitutes theft.
I will be looking in suing bank of america. I hope lots of people will join me.
