Ripoff, holds escrow checks, lack of processing false promises

We received a check supposedly for escrow/overpayment of funds from our refinance.

The check is not able to be cashed, not that we would because that would be accepting the amount as settlement when it was inadequate. It is made out to my husband, myself, and another spelling of my husband's name, which according to my bank may be another person this check was intended to also be endorsed by, and therefore cannot cash without this 3rd signature and proper ID from that person. Since the bank cannot verify who the owners of our home were without copies from Fairbanks. Of course, We cannot get any answers from Fairbanks regarding this. We are tempted to send it back, as they have done to so many others as inadequate payment. If we could possibly get away with cashing it and putting it in a "suspense fund" or Other Misc Fees we would, but of course we don't have the unethical practices of Fairbanks, so we have no choice but to send it back through an attorney as insufficient settlement of escrow and overpayment fees.

Also, they still have not recorded, or at least sent us the documents our reconveyance in the county where they finally paid our taxes. Fairbanks claimed I did not want them to do this, HA! Right, don't record our documents proving you have no legal access or rights to our home any longer. Another illegal tactic on their part we are sure.
