Portfolio Recovery Associates sent me a letter claiming that I owe them $3395. I disputed the validity of the debt by sending them a letter. I heard from them again and sent another letter.
Sometime went by, and I got a letter from an attorney over in North Dakota. My attorney said not to worry, they are not from this state. Next thing I know, these attorneys from SD are licensed in Minnesota and sued me. I was told by this attorney that I had no chance but to make a settlement with them.
I called and talked to the attorneys, and they told me that the people who sued me was a credit card company. So I was lied to by the attorneys as well. This sounds like a huge scam! I was scared and didn't know what to do. So, like a fool I made an agreement. I lost my job shortly afterward; I was unable to make any more payments, and they got a judgement on an old bank account of mine. I only had $2.94, so they could not take anything.
Since then, I have found out that it is illegal for a company to buy up a debt that is about to come off of your credit report. The debt that they bought was just days away from coming off my report. Also, when a person disputes the validity of a debt, and the company that claims that they are owed money to and do not furnish proof, it is also illegal for them to sue. That is what Portfolio did to me. Illegally sued me and thier attorneys in ND committed fraud by misrepensentation. I can't have a bank account anywhere in this state, since they have a judgement on me and can get my funds at anytime without warning.
I have reported them to the MN state Attorney General's Office. They told me to get a hold of the Department of Commerce. I did and nothing has been done. Please someone stop these people and put them in their place.
