This is the letter we sent to ASC, we contacted them to get a physical address. Today they are saying that the property was never in a short sell status after sending us a letter that it was and getting all of the Realtor's information, signed and notarized.

To all parties of interest;
My Wife and I have recently had to put our home for sale in order to avoid being foreclosed. We agreed with Your Company (ASC) to do a short sell. We contacted the mortgage company recently to ask them how we would go about, if we were to turn the power and water off in the home, due to the fact, that it is still in our name. We agreed to contact the mortgage company once we decided what we were to do. The mortgage company told us that a fee was to be assessed in order to winterize the home. This eliminated us from using (ASC), because we did not have the money for the winterization. The mortgage company took it upon themselves and broke into the house, breaking in through the back door, breaking windows and locks and changing the back door locks. Without anyone ever authorizing this. We had no idea at first who had done this, so we called the police and filed a report. It was a very odd situation, because the broken window had been boarded up and the door lock had been changed.

At first we thought that maybe squalors had done this, looking for a place to sleep. Nate, from the Wells Fargo's Damage Prevention, admitted authorizing a work order as to the entry and winterizing of our home. He then forwarded the work order to Emily Chrissem, who authorized Mike Davis, the contractor to enter the home. About a week later the (ACS) agreed to send the same contractor, Mike Davis to fix the damage that he had done previously. One night, my Wife had disarmed the alarm for the contractor to come back in. The contractor was the only one that had this information and keys to enter the home. Well, someone did come in, someone that had a key to the house, because there was no forced entry. Now the locks they had changed previously we were never given keys to. So, the night before someone was to come in and fix the back door, the window and locks. Someone let themselves in and stole a lawn mower and a leaf blower that I still had in the garage. Again, we filled a police report.

ACS had hired a contractor (Mike Davis), to so called "winterize the house, which what they did was burglarize the house. They opened the water heater valve, in order to drain it, and let the water run all over the basement floor. Ruining boxes that I still had on the basement floor. They bent the shut off valve to the main water line in the basement. Very unprofessional. We want to know who this contractor was so we can help the police with their investigation. Mike Davis is the name we were given, the person of contact. He was the one responsible for the initial break-in and then the one that was to come back and fix what he had damaged. His number is (732) 470-5615. This is all the information that was ever given to us. We did put his name and number in the police report; he has refused to answer any of our calls. He did send someone to fix the windows, never fixed the dead bolt lock, the lock to the screen door and the lock on the door jam itself.

We need his information, company name, address, who he has working for him in order to file a report directly to him from the Better Business Bureau. We contacted you only to be harassed by Jason from customer service that was very rude to my wife. He refused to give us any other information and told her that (ASC) had every right in breaking in our home the way they did, in order to protect their investment. What about our investment, all the years and money that we put in to this property. Do you honestly think that we want to loose our home? In 14 years no one had ever broken into our home. To then be treated as sub-human because of our misfortune. I even sought a Realtor Jerry S., sent you letters authorizing him to be in charge of this property. He, beside us, was the only one with keys to the property. He would have not had a problem letting the contractor in, through the front door; all he had to be was notified. Jerry lives less than a mile away. I personally go to the house and clean up, make sure everything is ok several times a week. We now realize that our efforts to do the right thing go unappreciated.

We tried working with your mortgage company to stay in our home, you re - modified the loan with a higher interest rate and higher payment. You are willing to accept the sell to someone else at the current market value, but refuse to offer us the same deal. We had agreed to a short sell to avoid foreclosure, but (You) claim that even in a short sell the foreclosure proceedings continue... Now you are refusing to return any of our calls, and tell us that we needed to hire an Attorney...
