Drilled-out all outside locks and replaced with cheap door locks and winterized our home after only 60 days delinquency

We have owned our home for two years and for most of that time we have been trying to sell it. The market in Nevada is saturated with foreclosures and we had no luck selling our home, nor could we refinance because the home would not appraise for what we owe on it. My husband had a nervous breakdown trying to keep up with the ever increasing mortgage payment for our home and the rising cost of living in general. We were current with all of our bills until he had the nervous breakdown. Our family physician suggested a change in lifestyle and job, so we decided to move out of state to be closer to family and a slower paced life.

We let our mortgage lapse so that we had the option of short selling or possible deed in lieu of foreclosure (the bank won't speak to you about either if you are current on your payments). Our missed payments started in April.

We started the deed in lieu of process in June. Wells Fargo neglected to get back to us as to the status of our file, I have to keep calling them. They however keep calling weekly to see if we intend to make up the missed payments. Recently, they finally told me that they did not think we qualified for a deed in lieu of because we have a home equity loan (which they knew of the whole time and only recently said a d.I.L. Would probably not be likely). Also, the home equity loan is through them as well... Same company but not qualified for d.I.L...??? They suggested a short sell.

We contacted our previous realtor and they began the process of listing our home. We were contacted on July 21 saying that our house had been vandalized and that the key provided for entry to our home would not work. I drove the nine hour drive with my two small children in order to see what the damage was. When I arrived at our home, there were blaring winterization stickers on my front windows saying that the mortgage company hired a contractor to winterize the home on May 29 (without our knowledge or consent), also the contractor drilled-out every lock and replaced them with cheap door locks. I tried to contact Wells Fargo to gain entry to our home, as it still is our home. They gave me the run around with incorrect phone numbers and everytime they said they were transferring me to the "Property Preservation" department it would disconnect me. I told the different people that I spoke with at Wells Fargo about the locks being drilled out and each time they responded by saying that an investigator for Wells Fargo did a drive by of the home and found it to be abandoned, so they winterized it and replaced the locks to keep bums out. They replaced the locks with the absolutely cheapest locks that are sold. They sole purpose was to keep us out!

I told our realtor of these issues and he reassurred me that this was not allowed... Wells Fargo had no right to drill out our locks or to winterize our home without our consent, especially that early in the game... It was just 60 days delinquent in payment. The home is still ours until the actual sell of it at a foreclosure auction. The realtor advised me to hire a locksmith and to replace all the locks with decent locks. The locksmith came and said that the way that the contractor left our home with the cheap locks and winterization stickers blaring on the front window just left the home wide open for vandalism. He said that they installed the cheapest locks available and that if their intention was to just gain entry to winterize the home they didn't have to go to the lenghths that they did by drilling every lock out. They were trying to keep us out of our own home after only 60 days of no payments. You can't even do a short sell until you are 90 days in arrears. We have very nice appliances and the home is very beautiful and Wells Fargo left our home very vulnerable to thieves and bums. I am sure that if anything happened to our home because of their actions (the winterization and locks drilled) they would still hold us accountable. I am very disgusted in the way that they have handled this matter. Especially since I answer every phone call that they give weekly regarding payment and I also call in weekly to the loss mitigation dept. To discuss our d.I.L. Of application and no mention of this so called winterization has ever been mentioned to me!

We have since listed the home for short sell and hopefully it will go through. The "Property Preservation" department from Wells Fargo has never returned my call.
