In August judge in divorce awarded me certain property. March received hail and wind damage to home. I hired contractors and had repairs done. November severe hail and wind damage. Because the insurance check (payable to myself and BOA only) is over 10k, BOA insists that I send the check in to them and open a construction account. Now I understand they do this to make sure the collateral is being repaired. The catch is when they issue a "draw" check it has both my ex and my name on it because he is on the mortgage loan. The only way to get him removed is refinance. Funny, when you are married and get a mortgage you have 2 incomes. I know a lot of people who have mortgages and not one single one of the females could afford to refinance if they got the property in a divorce. Statistically, men make more than women...
Anyway, BOA says my only option is to contact my ex to have him sign the "draw" checks. During the divorce, my soon to be ex drove by my house every morning and night. Poured a bucket of nails in my driveway - he's in construction. Hummmm wonder where those nails came from? Was caught at the end of my street at 9:45 at night at a vacant property. Had multiple bills of mine changed to his PO Box. Unplugged my sewer system and other miscellaneous acts of vandalism and theft. Last time I saw him outside of court, he grabbed me by the back of my hair. ALL of these incidents I have witnesses with phone numbers, dates and times as well as Sheriff reports. Does this really sound like someone I need to be in contact with? I don't even know where he is at. So how is someone supposed to get their house repaired?
