Fairbanks took over my loan in July. Since then I have had numerous problems with them. One being last year they did not pay my property taxes and I had to fight with them about that. Recently though is the worst possible!!! I called in Sept to make my payment by phone like I have been doing for over a year.
I was told by their rude customer service that I had a bad check and could no longer make a phone payment. I argued this because I have proof of no such bad check. I was transferred I don't know how many times. I got answers like this, your account is in bankruptcy, you have a forced insurance policy placed on your account.
We did have a bankruptcy back in 1999. Obviously we did not include our home or why would I even be paying??? They also told me they could not collect on the account since it was in bankruptcy. I tried to explain it is not in bankruptcy. But of course they do not care what you have to say. I asked for an inquiry into the account to find out what was going on.
They had changed my payment without notice, sent me an escrow refund in August, and no one seemed to know why. So I waited my 30 days for the inquiry. I called Nov first to make my Nov. Payment and ask where to send it, also to check the inquiry since I had heard nothing. They acted like I hadn't even asked for an inquiry. Nothing had changed my account was still all messed up. I was told I would have to mail my payment to a PHoenix office.
When I asked if they were putting anything negative on my credit they said the could not tell me. So I ordered a credit report. To my horror there in black and white Loan servicing center reports bankruptcy proceeding started as of Sept. The month I asked for an inquiry!!! But it also says never late. Of course I call them imediately. They are rude do not know what I am talking about say they can't give me the department that reports to the credit bureau. They say but if they are wrong it will be removed. Yeah right! I have all my checks and bank statements since they took over and I am ready to take them to court. This is ridiculous.
I have placed a dispute on my account with their customer advocate but that takes up to 60 days if they even do anything.in the meantime it is Nov and if they started foreclosure in Sept we all know what that means. I called the courthouse in Indiana where the property is and so far no papers are there but also I did not recieve papers.
These people are not trust worthy. If I had not ordered a credit report I would have not known what they were doing. I have filed a complaint with the federal trade comission and attorney general and hope that everyone else will do the same. I f they get enough reports they will investigate. Hopefully before we all lose our houses for no reason!!!
