My daughter recieved a letter 3-3-08, stating she owed $4700.00, in 1986. She was 18 yrs old and had only a $500.00 limit with First Omni Bank Credi Card. I research this and they no longer exist except as a Mortgage Co. They would not be consired about a $500.00 debt on a credit card. They are also with Lending.com. They stated my name and my husbands name was on the credit card application and gave our last 4 digit SS#. They threatened to put a lien on her house and put it on her credit. She is 40 now and doesn't remember this company. They wanted to settle for 2700.00 if they paid with credit cards today or payments of 300.00 a month until paid. My daughter called me with this story.
I called them, since my name was on it and they said since she did not remember, that my daughter was going to sign a frauduant statement on me. I must have gotten the credit card in her name without her knowledge and I would go to jail. I ask what they where trying to pull, because the statue of limitations was out and they can't do what they threatened to do to my daughter. I didn't commit any fraud. They said they could not discuss this with me, because they were going to go after me as soon as she sign the statement. I asked her if my name was on the credit card information and they said no. I told them that they gave my last 4 digits of my SS# and they said they was not going to speak to me about that. I asked how they got the information and she said, "Have a good evening" and hung up on me.
My lawyer advised me this was done illegal and he would write a letter on my behave and the threats were violation of the Federal Trade Commision, Fair Credit Act. I filed a report with them.
