MCM Expired Statue of Limitations

MCM tried to collect on an old HSBC Card Services account that I closed in 2006. They sent me a collection letter on 11-15. I knew the account was old, so I pulled my credit report and they had reported it to the credit bureaus, but the credit bureaus seem to be getting wise to collection agencies and their attempt to re-age old, expired debt and have started stating the Date of First Delinquency, which was 9 for this debt. The debt for my state, Texas, expired on 9.

What really blew my mind was the fact that they were trying to collect over $700. The limit on the card was only $300. As best I can recall, I only owed $128 balance. My husband and I were in a serious dilemma. We were laid off from our jobs within weeks of each other.

I sent MCM a letter on 11/21 informing them that the debt had an Expired Statue of Limitations per info recorded on my credit file with the credit bureaus. While I stated in my letter than I dispute this debt, my letter was to inform them that the debt had an expired statue of limitations per info recorded on my file with the credit bureaus.

Today, I get a letter from MCM in reply. They inform me that the debt in dispute is accurate and deny that there is any inaccuracy with the account. I didn't dispute the accuracy. I informed them that the debt has expired. MCM obviously didn't bother to read my letter.

I have filed a dispute with the credit bureaus on the same day I sent my letter to MCM. Of all things, it seems Capital One acquired HSBC's credit card debt including expired debt and there are two entries on my credit file for one debt - duplicates. The credit bureaus are still investigating as of today, December 5.
