I dont know how this company can get away with this! I have been dealing with them for the last two years with no affect at all. I have finally gone to an attorney but am not all that confident that anything will come of it.
Two years ago I disputed something they had reported on all three of my credit reports. I sent the letter of dispute via certified mail not only Asset, but to all three credit reporting agencies and the FTC. My efforts resulted in nothing so I repeated this process several times. Suddenly I began to get phone calls from Asset demanding payment. I referred them to my previously written letters and hung up.
Three months after my initial letter of dispute I ran my credit reports again. I was shocked to see that the Asset account had been re-aged; a term I had never heard before. Prior to my letters of dispute their account was due to drop off (by law) of all three of my credits reports in August; now it stated that it would remain until August!! I immediately called the credit reporting agencies; who were of no help at all! All three said the same thing they were not responsible for the information on my report and only those that reported the information could change it. They told me to contact the FTC; so I did. Another dead end! I filed a report online and sent a formal letter of complaint (certified return receipt) along with pages and pages of documentation. That was a year and a half ago and I have heard absolutely nothing. Am I the only one that sees this system as a joke??? I mean come on! Where are the checks and balances?
As a last resort I called Asset: BIG MISTAKE! First they told me that it was simply an error and come August it would drop off of my account. Naturally, I requested a letter reflecting this and was assured that it would be mailed right away. Nothing came.
About two months ago Asset began their phone call campaign again. We played phone tag for some time before I reached an actual living person. They offered to settle the debt for about 15% of the original balance; I thought this was a pretty good deal. I told them that I would gladly pay the money to just be done with it. There was a caveat to my offer: I wanted a letter stating not only that the debt had been paid in full, but I also insisted that Asset agree to completely remove (in writing) the record from all three reporting agencies.
After getting transferred four times I was finally connected to a manger that sounded like he was all of 12 years old. I explained that it didnt make sense for me to pay the money with no guarantee that they would remove the information from my credit reports when it was legally due to drop of in two months. He insisted that the company policy would not allow him to send me a letter. I didnt budge and he became more and more belligerent. I stayed calm and eventually hung up on him when he began calling me a worthless loser, among other things.
The entry is still on my credit file and has been re-aged yet again. My attorney says that this is clear fraud and we can prove it. I have documentation of every phone call. I have copies of every certified letter and signed return receipt. I also have copies of my credit report prior to the initial letter of dispute showing the correct reporting date. Im just exhausted from all of this though. I keep asking myself what people do that dont have the education or resources that I do??? How can they get away with this? Why hasnt anyone stopped them?
