I checked my credit report in June and found Asset Acceptance had added a collection notice to my records. I was never notified of this action by them (which dated back at least six months) and wrote them to that effect, as well as refuting such a debt. They didn't respond. I wrote the three big credit reporting agencies asking them to remove this error and they said they couldn't do anything aside from noting in my record the "account" was in dispute.
I wrote Asset Acceptance again asking them to remove this item from my credit reports. They sent me back a notice of collection for $85 with no other explanation or verification of the alleged debt.
The only problem I can ever recall was with the phone company three years ago over a late bill for $65, so I sent Asset Acceptance a copy of that cancelled check and a copy of my bank statement showing the item had been cashed. They sent me another notice asking for a cancelled check (again) or a copy of a letter stating the original account was resolved.
I refuse to pay for a debt I don't owe. I lodged a complaint with the FTC that seems to have fallen into a black hole. How are these people allowed to do this? What recourse do I have? Is what they're doing legal? Do they have any obligation to provide proof that I supposedly owe a debt? Is the only way to resolve this by hiring an attorney?
