On my wifes account we sent Nextcard 3 months Payments ahead of time along with a letter explaining these were for the future payments while we were out of town.
They cashed all three payments but did not credit them for the appropiate months.
Then they sent a notice saying we had not made the payments, charged late fees and overlimite fees.
After sending a certified letter for notice to Nextcard of our intent to file against them in court, we received a letter that the case was refered to upper management.
Waiting for an answer from Nextcard, the next letter we got was from the FDIC stating Nextcard was in their receivership. They still owe us the the money.
My advise, Get an Attorny and QUICK!!! And file now don't wait.
